OF SEPTEMBER 8,1999, MEETING WITH THE NUCLEAR ENERGY INSTITUTE (NEI) REGARDING DESIGN BASIS INFORMATION l On September 8,1999, representatives of the Nuclear Energy Institute (NEI) met with the staff of the Nuclear Regulatory Commission (NRC) at the NRC's offices in Rockville, Maryland. The purpose of the meeting was to discuss a letter from NEl dated August 17,1999, that forwarded industry proposals for guidance on design basis information as defined in 10 CFR 50.2. provides a list of attendees. 4 The staff began the meeting by distributing a list of discussion points that it hoped to cover during the meeting. This list is included as Attachment 2. The staff noted that the schedule for resolving this issue is contained in the staff's response to the Chairman's tasking memorandum of August 7,1998, and the latest version calls for a draft Regulatory Guide (RG) to be submitted to the Commission by October 31,1999. The staff stated that they believe that, with a few exceptions and clarifications, the draft RG will be able to endorse the NEl guidance document forwarded with the {{#if:

The following is a summary of the consensus reached for each of the discussion poin ?fh}f : General Guidance
- 1. NEl agreed to modify the guidance as proposed by the staff in Attachment 2.

- 2. NEl believes that redundancy and diversity are only considered to be design bases functions p when they are specifically required to meet single failure criteria. To illustrate this point the Auxiliary Feedwater (AFW) System example in the NEl guidance was referenced. The

~ C. A. Carpenter l guidance lists the requirement for the AFW system to have sufficient redundancy to perform its safety function in the event of a single failure as the design basis function. However, it lists the fact that it is designed with two diverse power supplies and contains two motor driven pumps and one turbine driven pump as supporiing design information. The staff understood NEl's position but the staff considers the manner in which an SSC satisfies the regulatory requirements for redundancy and diversity to be a fundamental aspect of an SSC's design basis function as defined in 10 CFR 50.2
- 3. NEl confirmed that they intend for their guidance to be interpreted as limiting design bases values to those associated with design bases functional requirements. That is, design values such as AFW system design temperature and pressure not directly associated with the primary system functional requirements are not considered design bases values. The staff does not agree with this position. The staff believes that the design requirements associated with assuring that the SSC will not fail should be considered design bases. For example, the design requirements for assuring the AFW piping will not fail should be con'sidered design bases because the failure of the piping would prevent the AFW system from meeting its design basis functional requirement of providing water to the steam generators. The staff suggested that a structural integrity topical design basis may help in addressing this issue.
- 4. Consistent with the discussion above, NEl appears to believe that design values from codes should be considered design bases values only when they are associated with the functional requirements for the containment or the reactor coolant system. The staff considers design bases functions, as defined in 10 CFR 50.2, to include both active and passive functions for these (and other) SSCs and that controlling parameters for such functions may be derived from codes or standards. Consistent with the definition of design bases in 10 CFR 50.2, the staff does not expect the specific methodology presented in the code or standard to be part of the design bases, however, if a code or standard is required by regulation, or the licensee has committed to a particular code or standard, they are part of the facilities licensing bases. The staff considers licensee specified inputs, required for the application of the code, and code specified design values and constraints to be part of the design bases since they are " values chosen for controlling parameters,as reference bounds for design." For example, in the case of the ASME B&PV Code, licensee inputs such as pressure and temperature; or Code specified design values, such as, allowable stress or maintaining a cumulative usage factor (CUF) of less than 1, are considered to be part of the design bases. However, design outputs, such as pressure vessel wall thickness, obtained from the application of the ASME B&PV Code methodology and licensee specified design inputs would not be considered by the staff to be part of the design bases.
Specific Guidance l
- 1. NEl agreed to modify the first paragraph to make it clear that the boundir g conditions may include normal operation. They noted, however, that SSC design conditions specified for the l
normal operation are included as part of the design bases only if the normal operating mode of l the SSCs provide a function required by regulation or is credited in the safety analyses.
