New FITNESS FOR DUTY POLICY Subject OBJECTIVE It is the objective of the District to establish and maintain a safe and healthy work environment and to reduce accidental injury to person or property, absen-teeism, tardiness and substandard job performance caused by the use of any drug, including alcohol.

It is also the objective of the District to ensure that its employees conduct themselves, both on and off the job, in a manner that promotes public confidence in the District's ability to meet its responsi-1 bilities.

POLICY The use of any drug, legal or illegal, which significantly alters Drugs or impairs the mood, perception, or judgment of any individual while engaged in job-related activities, or the use, sale, or possession of illegal drugs, is inconsistent with the District's above-stated objective and is prohibited.

Off-the-job use, sale, or possession of illegal drugs can adversely affect a person's job performance, jeopardize the safety of co-workers, or adversely impact on the confidence of the public in the District's ability to meet its responsibilities, is inconsistent with the District's stated objective, and, is also prohibited.

Alcohol - The use of alcohol during working hours or while otherwise on active assignment, while on District property, or while using District vehicles, is inconsistent with the District's objectiva of operating in a safe and effi-cient manner and is prohibited.

Additionally, no one shall report to work at the Dist-ict or be on District property while under the influence of alcohol.

REQUIREMENTS In accordance with this policy on Fitness for Duty, the District requirements are as follows:

1.

The District shall have a Drug and Alcohol Testing Program which shall be designed tc help ensure that the District workplace is free of the adverse effects of drugs and alcohol.

The Progrcm shall include analysis (es) of urine and breath samples to detect the presence of drugs and levels of concentration of alcohol.

Testing shall be conducted under

the follcwing circumstances:

. pursuant to written directives issued under the authority of the Presi-dent. - The: tests :will be ' conducted and the results thereof analyzed

_ prior to employment -or transfer. Any outside applicant who has positive

. test results will not _be eligible for the employment sought and will

. have Lany offer of-employment withdrawn.

Any District employee who has. positive test results will not be eligible for the transfer sought and'will be subject-to paragraph _7, below.

b.~-For cause when the.following conditions arise:

1). When a
recsonable suspicion exists that the individual is under

.the influence of drugs or alcohol.

Reasonable suspicion is a

-belief-based on behavioral observations sufficient to lead a prudent person to suspect that the individual is under the influence of drugs orLalcohol.

When -an _ individual is in possession of illegal drugs or alcohol

'2) _ or when suspected illegal drugs or alcohol are found in the prox-

imity of~the individual's work place.

3) JWhen reliable information is provided that an individual is involved in the use, sale, or possession of illegal drugs.
4) When an. individual is involved in an accident or near accident 1while~ engaged in District work and there is reason to believe that human - judgement,. coordination or performance could have been affected : by drugs or alcohol.

In this event, testing will be initiated pursuant to written directives issued under the authority of the President.

c. : At such other times as determined to be necessary, pursuant to written directives issued under the authority of the President.
2. ' Discharge. is the - penalty for illegal use, sale, or possession of drugs during ' working hours, while on District property, while using District vehicles, or while on active assignment with the District.

Any illegal drug will be subject to ~ confiscation and delivery to the appropriate law enforcement agency.

l 3.

Off-the-job illegal use, sale, or. possession of drugs shall be cause for disciplinary action up to and including discharge.

4.

Employees who are using legally-prescribed or over-the-counter drugs which could affect their ability to perform their assigned duties in a safe and efficient manner must report the use of such drugs to their supervisory authority.

The District will evaluate the circumstances and determine whether-the individual is fit for normal duties or whether a temporary reassignment may be necessary.

5.

Employees who are determined to be under the influence of alcohol during working hours, on District property while using a District vehicle, or to be drinking on the job, will be subject to disciplinary action up to and including discharge.

8.

Employees who refuse.to participate in the Drug and Alcohol Testing Program required by. this Policy shall be discharged in accordance with the District's normal disciplinary policies.

/ EMPLOYEE ASSISTANCE PROGRAM L Employees.with personal drug or alcohol problems are encouraged to request assistance from the Employee Assistar.ce Program.

Participation in this program

is voluntary and confidential and shall not affect an employee's continued employment with the District; provided, however, that the employee must there-after comply with District rules and policies.

Participation in the Employee Assistance' Program shall not, however, prevent disciplinary action from being taken for any. unacceptable conduct, eitner in the past or in the future.

Each. supervisor shall ensure that all employees under his or her direction

-are aware of this policy.

Further, each supervisor shall be expected to actively. promote the goals of this policy, and other policies, instruc-

~tions, and programs developed and implemented pursuant hereto.

2.-

Each employee is responsible for understanding and abiding by this policy, and other policies, instructions, and programs developed and implemented pursuant hereto.

3.

The Division Manager of Human Resources shall be responsible for communicat-ing this policy to all employees.

4.

Each.Vice-President shall be responsible for the preparation of any such directives and procedures as are deemed necessary to implement this policy.

Issuance of any such directives shall be under the authority of the Presi-dent.

5.

The. - Corporate Security-Manager shall be responsible for monitoring the

~ implementation of procedures, instructions, contracts, and any other items necessary to implement the Drug and Alcohol Testing Program required by this Policy, and to make reports to the respective Vice-Presidents regarding such implementation.

L I. Purpose ~ -

This-directive.fis to provide for the Nuclear ' Power Group's

- implementation of ' the,- Fitness for Duty Program.

The NPG Fitness for Duty Program implements the District Policy for Fitness for Duty (see

~

4 Reference A).

II. Scope-

. A.

Fitness for Duty Program The Fitness._ for Duty Program is

. applicablel to.sil NPG employees and -other personnel who perform r

work related to the District's Nuclear Program.

B.-

Fitness;for Duty Training 1.

The Fitness for Duty' Employee Training Programs are applicable to:

a.

All NPG Employees b.

_Other District employees who have unescorted access to CNS.-

c.

All Non-District pereonnel with unescorted access to CNS including officers,

agents, representatives, and employees of contractors and consultants, vendors, inspectors and1 Nuclear Regulatory Commission (NRC)

~ personnel and representatives.

2.

-The Fitness for Duty Supervisory Training Program is applicable.to:

a.

C.i Drug and Alcohol Testing Program

~

The Drug ~and~ Alcohol Testing Program is applicable to the following

' individuals:

1.: _All outside applicants who are offered employment in the NPG.

2.

All NPPD-employees who are applicants for employment in the NPG.-

3. All-NPG employees except those who are specifically excluded s

by recommendation-of the appropriate Division Manager and approved by the Vice-President - Nuclear.

4.

.All NPPD employees outside the NPG whose job responsibilities

. require unescorted. access to CNS as determined by the

~Vice-President.

Nuclear.

5.

NPPD-Senior Management personnel or others who voluntarily apply for.or hold unescorted access to CNS.

6.-.All consultants - contractors, and vendor employees or w;

representatives who require unescorted access to CNS.

7.

. Inspectors-and NRC and other regulatory agency employees and

. representatives who require unescorted access to CNS.

D.

. Employee Assistance Program - The District supports and maintains f

.an Employee Assistance Program (See Reference B).

e 1.

Availability

-Employees experiencing personal drug or alcohol problems are encouraged to voluntarily seek assistance through the Employee

-Assistance Program to resolve such problems before Management referral or disciplinary action is required.

2.

Volunteering Volunteering to participate in the Employee Assistance Program will be viewed positively and shall not in and of itself result in disciplinary action.

However, participation shall

Prevent normal disciplinary action for a violation (s) which may have already occurred or may occur after volunteering for participation in the Employee Assistance Program; nor b'.

Relieve an. individual of the responsibility to perform assigned duties in a safe and efficient manner.

III.-Implementation This directive is effective'immediately upon approval by the President.

The requirements of this directive will be implemented on a schedule determined by the Vice-President - Nuclear.

IV. Responsibilities s

ll.

Vice-President - Nuclear.

The Vice-President - Nuclear has the overall responsibility for the effective implementation of this directive. He shall ensure that the program is effective through monitoring of the implementation and shall modify or cause the modification of the program as necessary to ensure the program's effectiveness. He shall approve, in writing, the positions which do not require unescorted access to CNS.

B.

Division Manager of Nuclear Support.

The Division Manager of Nuclear Support shall be responsible for arranging contracts with organizations to perform the laboratory rests required by this

-procedure.

He will ensure that appropriate chain of custody, q'tality. control-and quality assurance provisions are incorporated into the contracts.

He will also ensure that accurate and appropriate reporting of laboratory tests, in accordance with this procedure, are included in the contract provisions with the laboratory performing the tests.

He shall develop and implement the random selection process for drug and alcohol tests and notify the appropriate Division Manager of the individuals selected for random tests.

He shall assure that the necessary qualified

-equipment with qualified operators are available to conduct tests that are performed by NPPD. He shall be responsible for providing detailed procedures for the collection of specimens, the conduct of tests and the reporting of test results.

He shall have overall responsibility for training required pursuant to this directive.

C.

Division Managers. Each Division Manager shall be responsible for

,r-the implementation and administration of the Fitness for Duty Program for all individuals under his supervisory authority.

He shall ensure that all persons for whom he is responsible receive the necessary inforcation and formal training and shall ensure that 3

call; training is properly : recorded.

This includes both the-naupervisory_and employee Fitness for Duty-Supervisory and Employee Training. Program.. He sh'all ensureLthat individuals selected for

. testing-are. notified and the tests conducted as scheduled.

He shall, ensure that'the consent form is executed for each individual

He shall ensure that each individual tested is notified of any positive - test results in accordance with this procedure.. In the - event of positive test results, he is n

He will ensure that the training Programs cover.any regulatory requirements, District Policy and NPG Procedural ~ requirements. He will also ensure that the training is

-provided on a timely and consistent basis in response to training

.needs specified.by the Division Managers.

E.

The Manager of the Human

~ Resources Department will ensure that all job offers for positions in'NPG or otherwise requiring unescorted access to CNS contain a statement that the offer 'is contingent upon the successful 4

completion of. drug and alcohol tests required by this procedure.

'He is responsible for developing, maintaining and implementing the Employee' Assistance Program.

He will make available for employee use and associated training information relative to the Employee i

Assistance Program.-

Managers and Supervisors.

Managers and Supervisors shall be responsible. for providing to each individual for whom they are p.

responsible information concerning the Fitness for Duty Program.

This information shall include the Districts' Fitness for Duty

' Policy, the Employee Assistance Program and this procedure.

- G.

Employees.

Employees shall not report to work under the influence of drugs or alcohol nor use illegal drugs or alcohol during working hours. They will be responsible for notifying their supervision if they are taking any prescribed or over-the-counter drugs that potentially could effect their ability to perform their work l

activities in a safe and efficient manner.

Policy Requirement's

In accordance with the District's Fitness for Duty Policy the'NPG requirements-are as follows:

. Discharge is the~ penalty for illegal use, sale, or possession of' drugs during working hours, while on District property, or while using District vehicles. Any illegal substance will be subject : to confiscation and delivery to the appropriate law enforcement agency.

~0ff-the-job use, sale, or possession of illegal drugs shall be

' When an employee is arrested for off-the-job drug activities, s

that employee's unescorted access to CNS shall be immediately revoked and the employee will be subject to a drug test as

District Management will evaluate the circumstances surrounding the arrest and take appropriate actions regarding future work assignments.

5. _ -Employees under the influence of alcohol or determined to be drinking.during working hours, or possessing alcohol on

District property or using a District vehicle will be subject to disciplinary action up to and including discha:ge.

Employees drinking or possessing alcohol ' inside the protected: area of CNS shall be discharged.

b.

Alcohol consumption is prohibited during the workday, including rest periods and meal periods. Notwithstanding

-this, there may be occasions, removed from the usual work setting, at which it is permissible to consume alcohol in moderation.

Employees who consume alcohol under such circumstances shall not report back to work during that workday, and any time taken of f-the-j ob under such circumstances shall be taken as vacation or as time off without pay.

c.

-The possession of alcohol in a personal vehicle on or off of District property is not prohibited by this procedure, provided-such possession'is in compliance with state and local laws.

d.'

These provisions shall not prohibit the use of alcohol occuring after the close of the District's regular business hours, at retirement parties, banquets or other like business-related functions sponsored by the District, nor shall they apply to the use of alcoholic beverages on District-owned property when made available to District personnel for recreational and vacation activities.

Use of alcohol off-duty at official or District-sponsored functions does not relieve any employee of their responsibility to conduct themselves in accordance with the law and in such a manner so as not to adversely impact the reputation of the District.

Employees scheduled to be on call are expected to be fit for duty upon reporting for work.

An employee scheduled to be on call who is called out and is perceived to be under the influence of alcohol will 6

As soon as supervisory authority has any ~ indication that an individual ~ may be abusing drugs or alcohol, and in addition to any other action that may be provided for by this procedure, the individual shall be informed and reminded of

..'the assistance available through the Employee Assistance

>r Program.-

7.

All outside applicants and District transfers into NPG or a

otherwise to a position requiring unescorted access to CNS shall be required to sign a consent form, submit the required

specimens and pass the drug tests as provided in this procedure. Any individual who has positive test results will not be eligible for that employment and any offer previously made shall be withdrawn.

8.

All consultants, contractors, inspectors and vendor employees and representatives who require unescorted access to CNS shall pass the drug and alcohol tests as provided by this directive or a comparable test conducted by the parent company and approved in writing by the District. Any such personnel who have valid unescorted access to CNS prior to the approval date 7

9.. _ Nuclear Regulat'ory Commission employees, inspectors or representatives, who. require unescorted access to CNS shall

' pass the drug and alcohol tests required by this procedure or a comparable test conducted by-the NRC and approved.in writing

-has positive results for any test required by this procedure the Administrator of NRC. Region IV will be so notified. and

' 10. All individuals with unescorted access to CNS shall be subject to being - randomly selected for drug and alcohol testing.

Those~ selected shall.be required to sign the consent form and 9

submit the required specimens.

in immediate revocation of unescorted access.

If the

individual is a District employee he will be notified of such results~and the options available in accordance herewith.

If theLindividual is a consultant, contractor, or vendor employee or representative, the parent company will be notified and E

' instructed to remove the individual from CNS, or other District property.

If the individual is an NRC employee, inspector or representative, the Administrator of NRC Region IV will be notified and that individual will be provided escorted access if the District is so directed by the NRC.

11.

In the event a District employee has positive results from the drug and alcohol tests provided by this procedure, that employee shall immediately be denied unescorted access to CNS.

That employee will also be placed on administrative leave without pay and suspended from all duties. The employee shall be given the choice of participation in the District's Employee Assistance Program or be discharged in accordance with - the District's disciplinary / termination policies.

The employee will be given seven (7) days from the date of notification of the positive resul.ts to notify the District of his of her desire to participate in the Employee Assistance Program.

If the employee elects to participate in the Employee Assistance Program, the employee will be considered in a leave status and may use medical leave, vacation time or 8

~ unpaid leave in'accordance with District policies, until he or she complete their participation in the : Employee Assistance (Program, return to work status or are terminated in accordance with the provisions-of this procedure. The program will be updated as necessary to include the most current District and NPG policies, industry standards and regulatory requirements.

Each supervisor must successfully complete the training within six months after the date of this procedure.

Retraining will be conducted at intervals not to exceed three years.

'the-individual's work place.

When reliable information is provided that an individual is involved in the use, sale, or possession of illegal drugs.

'When an individual is involved in an accident or near accident while engaged in District work and there is reason to believe that human judgement, coordination or performance could have been affected by drugs or alcohol.

In this event, testing will be initiated immediately af ter the accident or near accident.

Testing Requirements 1.

Drug and alcohol tests shall be carried out under detailed procedures which insure individual confidentiality, secure chain of custody, and which are valid and reliable in

-accordance with current professional and industry standards.

2.

Drug testing under the District's policy will be performed on urine specimens provided by the individual being tested.

The specimens will be -collected in accordance with a detailed written procedure which will accompany each specimen kit.

The collection procedure will include provisions for information to be supplied to the individual being tested, witnessing the specimen collection, sealing the specimen container, and instructions for transmitting the specimen to the testing laboratory.

(See Attachments A and B)

Upon receipt of the specimen, the testing laboratory will divide the specimen into aqual parts.

If the presence of substances defined above is not confirmed, then the result for that specimen is negative.

If the result is negative, the remaining one-half of the specimen

If the result is positive the remaining one-half of the specimen will be retained until further instructions for handling the specimen are received from the District. The District:shall be immediately notified of positive results of t-specimen tests. The Vice-President - Nuclear or his delegated representative shall be the District's designated person to receive notification of positive test results.

Alcohol testing will be conducted on breath samples.

The testing will be performed in accordance with Nebraska Department of Health Rules and Regulations Relating to Analysis for the Determination of the Alcohol Content of Body Fluids (Neb.

If the results of drug tests are positive the Vice-President -

Nuclear-shall take, or cause.to be taken, actions as follows:

a.'

In ' the case of contractor, consultant, non-regulatory inspector or. vendor personnel, unescorted access shall be immediately revoked and the individual's company informed of the test result by presentation of a copy of the test result produced by the testing laboratory.

No further action shall be taken to reinstate the individual's access.

.,4 b.

'In the case of District employees, the employee concerned shall be suspended without pay and be denied unescorted access to the protected area.

In addition, the employec shall be suspended from all duties without pay pending disposition of the matter.

The employee shall be given the choice of participation in the Employee Assistance Program, or be discharged in accordance with ordinary District disciplinary policies.

The employee shall notify the District of his or her choice to participate in the Employee Assistance Program within seven days of notification of the result of the test.

c.

If the employee accepts participation in the Employee Assistance Program that employee shall continue to be in nonwork status and denied unescorted access to the protected area until it can be ascertained through subsequent tests that the employee is " drug-free".

This procedure shall involve a drug test once each week for three weeks to determine the presence of drugs in the employee's system.

If the NRC Region IV Administrator so. directs, the individual will be provided escorted access to CNS.

unescorted access to CNS, the individuals unescorted access to CNS will be immediately revoked and the President of the District notified. The disposition of any disciplinary action will be determined by the President of the District.

Attachment C ALC0HOL TESTING

-I.' Equipment The' testing equipment to be used in the NPPD Alcohol Testing Program in the :Intoximeter 3000 which is manufactured and sold by Intoximeters,

,Inc.,' 1901 Locust Street, St. Louis, MO 63103.- See V, below, for the specifications for the Intoximeter 3000.

II. Operator Qualifications Operators who perform alcohol breath tests shall hold a Class B Permit in accordance ' with Nebrasha Department of Health Rules, and Regulations relating to analysis for the determination of the alcohol content of body fluids.

(Nebraska Administration R Title 177, Chapter 1, 1986). See VI References of NPG Fitness for Duty Program.

III. Maintenance Requirements Maintenance shall be' performed in accordance with the manufacturer's recommendation (Intoximeter, Inc.) and in accordance with Nebraska Department of Health : Rules and Regulations relating to analyses for determination of ~ alcohol content of body fluids (Nebraska Administration R, Title 177, Chapter 1,1986).

IV. Operating Instructions A.

Unpacking and Set-Up

.l.

. Remove the IR 3000 from the shipping box.

Save the box and packing material in case it is needed to ship the instrument back for repair.

2.

Plug the IR 3000 into 110 VAC outlet.

The display should contain a circulating message consisting of " PRESS START TO TEST the date, day, time and year".

3.

Leave the IR 3000 plugged in for at least one (1) hour.

This is done to make sure the unit is up to temperature.

If the unit is not up to temperature, a " LOW TEMP" message will appear in the display after the start button is pressed.

Press the

" CLEAR" button to return to the circulating mode.

PRELIMINARY TEST a.

Prepare a.10 gm% alcohol standard in a Smith and Wesson simulator.

b.

After programming the IR 3000 to run an external standard press START key.

If LOW TEMP is displayed, the instrument is 'not warm enough to run test.

The LOW TDIP message should disappear before 45 minutes have elspsed.

c.

Connect the simulator to the instrument as shown in Figure 4.

Enter the Operator's and Subject's name.

The instrument will then purge, blank, and draw a sample from the simulator. The External standard reading should give a result between.095 and.105.

If the Standard readings are below.090 or above.110, the instrument will not 9

the 20th character will be the last character recorded.

For this reason, it is recommended to enter the last name first and to not include periods (.) af ter initials.

Remove the adapter and the sample tube.

Replace the caps on both ends of the tube making sure that gaskets were in each one of the caps.

If this message does not show, the adapter has not been inserted tightly enough.

7. - Complete all information on the mailing label and insert the tube into the mailing tube and seal with the sealing label.

The test printout will note when a sample has been taken by marking the test values with an asterisk and printout the lot and serial numbers.

-Operating Principles The ' Intoximeter Model 3000 breath analyzer employees the well-established principles of nondispersive infrared (NDIR) rv

molecular. absorption.

Each compound in the breath absorbs infrared energy. in a combination of absorption bands at frequencies' unique to the compound.

The position of these abcorption bands do not change.

However, the strength of a given absorption band wil1 ~ vary in direct relation to the change in the number of molecules within a fixed path.

The analyzer.uses a narrow bank pass interference filter to isolate-an absorption band at 3.39 microns; which is one of the strong absorption bands for alcohol.

A heated element sends

. infrared. energy through a two-chambered gas sample cell of fixed path length. With no absorbing gas in the sample half of the cell, the energy of the sample beam is ratioed against the energy - passing through the reference half of the cell.

The ratio is used to set and establishes the zero set point. The presence of alcohol in the sample cell will absorb some of the sample beam energy.

The amount of energy attenuated is proportional to the number of alcohol molecules in the sample cell.

The Infrarred Source The. source is a nichrome helix.

This assembly is then resistance-heated to 800 degrees C.

A single source is used to simplify the optics and electronies and to insure stability.

It is used so that any change in source character will have no net effect on the system.

Extensive source check-out and burn-in yields high reliability in operation.

Careful filter selection provides a readout free from interferences.

The Detector A solid-stage photoconductive detactor was chosen for its sensitivity aad fast response.

The detector is extremely rugged, and is insensitive to mechanical shock and vibration.

Printer Paper This printer uses thermal-heat eensitive paper. This paper is 4

available through Intoximeter, Inc., St. Louis, Missouri.

If other brands of thermal paper are to be used, first check with Intoximater to be sure that the paper is an approved type; as

-some brands are abrasive and will ruin the printheads of the printer. The following types of paper are acceptable:

The paper with the blue print fades over time, especially when put in plastic envelopes or folders.

Paper with black print is best for use with this printer.

Installing the Printer Paper The printer is installed by lifting the access panel (located on the top-left side of the instrument); then drop the paper roll in so that the free end of the paper unrolls from the bottom side.

The figure below shows the side view of the printer and how the printer paper is installed.

The paper release lever must be pulled toward the front of the instrument before the paper is installed.

This releases the pressure of the printhead. After installing the printer paper, make sure 17 19
