Dear Mr. Berkow:

We understand that it is now the Consnission's policy to amend outstanding facility licenses as soon as practical to eliminate the inconsistency between the maximum licensed power and the testing of power scrams at 110% of licensed power.

We have been informed that one of GA Technologies' (CA) license amendnents (referenced above) currently

.pending for our Mark F reactor (R-67) will contain such an amendnent concerning maximan power.

As the Commission knows, we have two licensed TRIGA reactors at our Facility.

It appears unreasonable that one of our reactor licenses will continue to permit testing of scrams at 110% power 4

whereas the other will not.

To bring both our reactors to the same status in this regard, we request that the Cmunission also alter the R-38 license in a similar fashion and that this licensing action be done with-out fee.

j To facilitate the referenced change for the R-38 reactor, we suggest appropriate wording that may be incorporated in the License as well as the Technical Specifications.

For the License, Section (1), and Section 7.1 of the Technial Specifi-cation, we suggest the following wording:

(1) Maximun Power Level

'Ihe licensee is authorized tc operate the reactor at steady state power levels up to a maximum of 250 KW (thermal) and up to pulsed power levels produced by a three dollar reactivity insertion.

Section 7.1

'Ihe operating power level shall not be intentionally raised above 0

250 KW except for pulsing operation.
