Dear Mr. Lawless:

This is in final response to your letter dated April 1,1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of enclosure one to the November 4, 1985, letter from the NRC to the Cleveland Electric Illuminating Company regarding allegations of work being done improperly by Metalweld, Inc., at the Perry nuclear power plant and any additional related records pertaining to these allegations since November 18, 1985.

The four records identified on enclosed Appendix D are responsive to your request. The records identified at numbers one and two are being withheld in whole or in part pursuant to Exemption (7)(A) of the F0IA (5 U.S.C. 552(b)(7)(A))

and 10 CFR 9.5(a)(7)(i) of the Commission's regulations, as noted on Appendix D.

The nonexempt portion of the record identified at number two is being placed in file folder F01A-86-254 at the NRC's Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555. The records identified at numbers three and four are being placed in their entirety in PDR folder F01A-86-254.

Information withheld pursuant to Exemption (7)(A) was compiled for law enforce-ment purposes. Release of the information would interfere with an ongoing enforcement proceeding and could allow those being investigated to learn the scope, direction, and focus of investigatory efforts and thus could possibly allow them to take action to shield potential wrongdoing or a violation of NRC requirements from investigators.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. Ben B. Hayes, Director, Office of Investigations.

Mr. Lawless This denial may be appealed to the Secretary of the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision.
