SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-298/86-29)
This refers to the inspection conducted by Messrs. R. A. Caldwell and
A. B. Earnest of this office during the period October 20-24, 1986, of
activities authorized by NRC Operating License DPR-46 for Cooper Nuclear
Station, and to the discussion of our findings with Mr. G. R. Horn and other
members of your staff at the conclusion of the inspection.

Areas examined during the inspection included compensatory measures, physical
barriers - vital areas, access control - personnel, access control - vehicles,

access control - packages, security system power supply, contingency plan
review, lock and key control, independent inspection, detection aids -

protected areas, and physical barriers - protected areas.

Within these areas, the inspection consisted of selective examination of...

procedures and representative records, interviews with personnel, and

observations by the inspectors. The inspection findings are documented in the
enclosed inspection report.
Certain of your activities were found not to be conducted in full compliance
with NRC requirements and license corsnitments. In accordance with the " General
Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2,
AppendixC(1987),theviolationsdescribedintheens40sedNoticehavebeen
classified at Severity Level IV. Violation A, described in the attached Notice
of Violation, involved a degraded vital area barrief'such that two of the three
elements of access control were inadequate. As indicated in Supplement III of
the NRC Enforcement Policy, significant violations of this type are normally
classified at Severity Level III. However, after careful consideration of the
facts that this situation was licensee identified, the corrective actions taken
by you were prompt and extensive, exploitation would have been physically

difficult and would have required knowledge of the structure and special
equipment, and the window of vulnerability was short, we have exercised our

judgment under the NRC Enforcement Policy and have classified this violation as
Severity Lesel IV. Similar violations of this type in the future may result in
additional enforcement action.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing yo'ur response. In your
response, you should document the specific actions taken and any additional
actions you plan to prevent recurrence. We request that your response
specifically address actions you have taken to ensure that future
maintenance / operational activities do not compromise the CNS Safeguards
Program. After reviewing your response to this Notice, including your proposed
corrective actions, the NRC will detennine whether further NRC enforcement
action is necessary to ensure compliance with NRC regulatory requirements.
The material enclosed herewith contains Safeguards Information as defined by
10 CFR Part 73.21 and its disclosure to unauthorized individuals is prohibited
by Section 147 of the Atomic Energy Act of 1954, as amended. Therefore, the
material, with the exception of the report cover page which is an inspection
summary, will not be placed in the Public Document Room.
The response directed by this letter and the accompanying Notice is not subject
