Subject:

PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty'Thousand Dollars ($50,000) will be issued on or about July 1,1986 to Consumers Power Company. This action involves inadequate corrective actions regarding~ excessive valve leakage identified in the Post Accident Sampling and Monitoring System in May and August, 1985. The licensee reported the leakage in connection with a December 1985 ,

failure of a local integrated leak rate test.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

Mailing of Notice July 1, 1986 Telephone Notification of Licensee July 1, 1986 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Michigan will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the respense, the civil penalty may be remitted, mitigated, or imposed by Order.
