Dear Mr. Berkow:
This will confirm our recent telephone conversations relative to the formal status of the Retired Battelle Research Reactor, formally licensed under Facility License R-4.
The status of the Battelle Research Reactor (BRR) continues to be governed by the technical specifications of License R-4, a " possess but not operate" license as set forth in Amendment No.13 to Facility Operating License No. R-4 and dated July 19, 1976.

We have continued to perform surveillance requirements as set forth by the technical specifications which includes quarterly radiological monitoring and

annual submissions of a formal radiological monitoring report. Specifically, Amendment No. 13 consisted of changes in the technical specifications that delete the operability and surveillance requirements for equipment no longer needed and subsequently removed following decommissioning.
We have been unable to locate any reference to a termination date associated with the Amendment No.13 or the R-4 facility license following this amendment.
Consequently, we have continued to operate within the technical specifications of Amendment No. 13. Within this context the responsibility for the administration of the facility is vested in the Retired Facility Site Representative (RFSR). The duties and responsibilities of the RFSR are spelled out in the technical specifications.
As to the physical plant, only the super structure of the BRR remains following the dismantling and decommissioning which was completed in 1975. There is no special nuclear material or accountable byproduct material on hand that is associated with the decommissioned BRR. This includes the shielded concrete containment for the pool, the associated beam tubes, and the former fission spectrum facility. Only residual contamination remains in the area of the beam tubes. These areas are surveyed and monitored in compliance with the tech specifications.

In order to rectify the current license status of the BRR we are, by copy of this letter', requesting NMSS to authorize a formal amendment to the Battelle Columbus License SNM-7 for the possession of residual radioactive contamination associated with the decommissioned Battelle Research Reactor (BRR). We further request that the residual contamination be controlled, monitored, and surveyed in compliance with 10 CFR Part 20, and if deemed necessary, in accordance with technical specifications as stipulated in Amendment No. 13 to the previously licensed Facility, License R-4.
