Dear Mr. O'Kelley:

l We have reviewed the final South Carolina regulations, Radioactive Material Regulations 6163 Title A amendments which were adopted by South Carolina on June 28,1996 and on September 10,1998. These amendments were provided to the integrated Materials Performance Evaluation Program review team during the week of July 12-16,1999. The final regulations are in response to the 13 amendments identified in the enclosed Regulation Assessment Tracking System (RATS) Data Sheet. The regulations were reviewed by comparison to the equivalent NRC reguir.tions in 10 CFR Parts 19,20,30,34,35,36,61, and

71. Mr. Woodruff in our Region ll Office discussed the review of the regulations with Mr. James Peterson of your staff, and Mr. Virgil Autry of the Division of Radioactive Waste Management on July 29,1999.

The regulation 4 adopted by South Carolina on June 28,1996 included modifications to the i South Carolina Title A regulations as follows: Part XI, Licensing and Radiation Safety Requirements for Irradiators; Part 1, General Provisions, Section 1.15, Financial Assurances and Recordkeeping for Decommissioning; and Part II, Section 2.11, Expiration and Termination of Licenses and Decommissioning of Sites and Separate Buildings or Outdoor Areas. The regulations adopted on September 10,1998 included: certain provisions in Part IV, Use of Radionuclides in the Health Professions, Definitions and Reporting Misadministrations; Part V, Section 5.6, Performance and Locking Requirements for Radiography Equipment; riart 111, Standards for Protection Against Radiation, Sections 3.2 Definitions,3.19 Respiratory Protection, Section 3.37 Determination of prior occupational dose, Section 3.48 Reports to Individuals Exceeding Dose Limits, Section 3.32 Transfer for Disposal and Manifest, Section 34.2 Subpart L-Records, General Provisions, and Section 3.35 and Appendix D, Requirements I forTransfers of Low Level Radioactive Waste Intended for Disposal at Licensed Land Disposa! A Facilities and Manifests; Part VI, Section 6.3, Instructions to Workers; and Part Vil, Sections 7.15 and 7.16 Transfer and Termination of Licenses, and Section 7.32 Records, Reports, Tests, and inspections. Finally, a regulation promulgated before September 1998 is Part 11, Section 2.22, Transportation of Radioactive Materials. We also reviewed our letter to you dated December 15,1997 conceming certain definitions needed for compatibility with NRC 10 CFR Part 20 (RATS 19913).

As a result of the NHC review, we have determined that the South Carolina regulations, as adopted meet the compatibility and health and safety categories established in OSP Procedure SA-200.
