August 25, 1999 ALL AGREEMENT AND NON-AGREEMENT STATES INCIDENT AND EVENT INFORMATION: NATIONAL DOMESTIC PREPAREDNESS OFFICE ACTIVITIES (SP-99-057) i Wa are writing about evolving Federal initiatives that could affect State and local organizations concemed with planning for certain types of criminal and terrorist acts in the United States.

Although the Federalinitiatives address a variety of potential criminal acts, the U.S. Nuclear Regulatory Commission's (NRC) particular interest is in assuring an adequate response to illegal acts involving nuclear and radiological materials that could endanger the public health and safety.

The Department of Justice has established a new National Domestic Preparedness Office (NDPO), staffed by current and former officials from a variety of Federal, State, and local agencies.' The NDPO has assumed overall responsibility for coordinating the Federal Govemment's efforts to prepare America's communities for terrorist incidents invoNing conventional or non-conventional weapons of mass destruction (WMD). WMD wuid employ chemical, biological, nuclear, or radioactive agents or materials and could involve a wide range of criminal acts. An example might be the theft of radioactive sources from a licensee to use in a radioactive dispersal device that would endanger the public health and safety. The NDPO will be the focal point for helping communities better prepare for recponding to attacks involving WMD. The NDPO will work with Federal departments and agencies to help streamline the

delivery of planning and preparedness assistance to local and State govemments. The i

NDPO's goals include the following: (1) coordinating and integrating Federal assistance programs to better prepare State and local officials to respond to WMD acts of terrorism within the U.S.; and (2) ensuring that existing State and local crisis and consequence management plans and Federal response plans for responding to a terrorist or other criminal act involving chemical, biological, nuclear, or radioactive agents interface effectively. The NDPO will draw on input from local and State stakeholders, in conjunction with support requirements addressed in local and State plans and the interagency Federal Response Plan, to assist in establishing priorities for Federally provided equipment, training planning and exercise support. In addition, changes have occurred within the Federal Bureau of Investigation (FBI) Field Offices. Each of the FBI field offices now has a designated WMD coordinator who will be responsible for FBI WMD response planning with State, local, and private-sector officials within their jurisdiction and will be the f acilitator for interaction between the NDPO and the State and i

The WMD coordinator also will serve as a point of contact for FBI operational response to incidents involving possible criminal and/or terrorist misuse of nuclear or radiological materials. Note that SP-98-038, dated May 5, 1998, provided information on the expansion of the FBI's criminalinvestigative jurisdiction to include byproduct materials, and also a list of FBI contacts.

The efforts to improve the capability to respond to criminal acts should not impact the planning in place for coordination of the Federal radiological assistance. In accordance with the Federal Radiologica! Emergency Response Plan (FRERP), the NRC is the Lead Federal Agency (LFA) for a radiological emergency involving material or a facility licensed by the NRC or an Agreement State. As the FRERP LFA, the NRC will coordinate all Federal assistance provided to the States for dealing with the radiological aspects of the emergency. The NRC will also support the FBI lead Federal response to the criminal aspects of the emergency.
