Dear Mr. Frazee:

As requested, we have reviewed the final Washington regulations submitted by e-mail dated July 20,1999: Notification of incidents, abandonment, and lost sources, WAC 246-244-240 (effective 7/9/98); Notification of incidents, WAC 246-221-250 (effective 7/9/98); and Reports of over exposures and excessive levels and concentrations, WAC 246-221-260 (effective 1/21/95). In addition, we reviewed the proposed revision to section of WAC 246-221-260, establishing reporting requirements for dose constraints on air emissions, expected to be effective on August 21,1999. The final and proposed regulations are in response to one amendment identified in the enclosed Regulation Assessment Tracking System (RATS) Data Sheet. The regulations were reviewed by comparison to the equivalent NRC regulations in 10 CFR Parts 20, 30, and 39. We also discussed our review of the regulations with you on

. August 12,1999.

As a result of our review, we have determined that the Washington regulations, as adopted, meet the compatibility and health and safety categories established in OSP Procedure SA-200.

Under our current procedure, a finding that a State regulation meets the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final State regulation. However, we have determined that if the proposed revisions to WAC 246-221-260 are adopted without significant change, they would meet the compatibility and health and safety categories established in OSP Procedure SA-200.

We have also summarized on the RATS Data Sheet our knowledge of the status of other Washington regulations. Please let us know if you note any inaccuracies or have any comments on the information contained in the RATS Data Sheet.
