Dear Mr. Frazee:

We have reviewed the change to the final Washington regulation - Financial Assurance and Recordkeeping for Decommissioning, WAC 246-235-075, which will become effective August 21,1999. The request is based on your August 11,1999 e-mail. We also reviewed our letter to you dated July 26,1999, that covered the financial regulation. The final regulation is in response to the one amendment identified in the enclosed Regulation Assessment Tracking System (RATS) Data Sheet. The regulation was reviewed by comparison to the equivalent l NRC regulation in 10 CFR Part 30.

J As a result of the NRC review, we have determined that the Washington regulation, as adopted, I meets the compatibility and health and safety categories established in OSP Procedure SA-200.

We have also summarized on the RATS Data Sheet our knowledge of the status of other Washington regulations. Please let us know if you note any inaccuracies or have any comments on the information contained in the RATS Data Sheet.
