CONFIRMATORi ACTION LETTER
Dear Mr. Binetti:
On September 17 and 18,1997, Keith Brown of this office conducted a safety inspection at the above address of activities authorized by the NRC license. The inspector found severalissues indicating weaknesses in your radtlon protection program, some of which had been identified in a previous inspection. Although, you had committed to revising your Radiation Safety Manta as part of your most recent license renewal, it was not clear during this inspection that the procedures implemented at your facility met all the requirements of the revision to 10 CFR Part 20. For example, some surveys of incoming packages containing radioactive materialin excess of Type A quantitles did not meet all requirements of l
10 CFR 20.1906. Also, you did not perform the review of the radiation safety l
program required by 10 CFR 20.1101 in 1996 and had not yet perforrned that revl.ew for the current calender year. In addition, the inspector found that you had not corrected a violation cited during the previous inspection concerning evaluation of dose to members of the public and of bloassay results. Finally, your procedures for accounting for special nuclear material used in plating fission countws did not appear to have adequate precision to determine the amount of materiallost in the manufacturing process, which may have led to discrepaneles between your running account of special nuclear material and physical inventories of the material.
Pursuant to a telephone conversation between you and Thomas Mike of Imaging and Sensing Technology Corporation, and Keith Brown and Pamela Henderson of the NRC on September 25,1997, it is our understanding that you will take the following actions:

Within 30 days from the date of this letter, complete the annual audit for 1997 as required by 10 CFR 20.1101(c) and submit a report to this office within 30 days thereafter describing the audit and its findings. Within 60 days from the date of this letter, revise your procedure for resolving discrepancies betwoon your running inventory of special nuclear material and your samlannuel physicalinventory of that material. Submit the revised procedure for NRC review and approval as a request to amend your license.
5.
Within 60 days from the date of this letter, update your Radiation Procedure and Safety Manual to take into account the major revision to 10 CFR Part 20 which was effective January 1,1994 and subsequent revisions to the Parts applicable to your NRC Materials License. Submit the revised Manual for NRC review and approval as a request to amend your license.

Notify me if for any reason you cannot complete the actions within the specified schedule and advise me in writing of your modified schedule in advance of the change; and 3)

Issuance of this Confirmatory Action Letter does not preclude issuance of an order formalizing the above commitments or requiring other actions on the part of the licensee; not does it preclude the NRC from taking enforcement action for violations of NRC requirements that may have prompted the issuance of this letter, in addition, failure to take the actions addressed in this Confirmatory Action Letter may result in enforcement action.
In accordance with 10 CFR 2.700 of the NRC's " Rules of Practice," a copy of this letter, its enclosure (s), and your response will be placed in the NRC Public Document Room (PDR). To the extent poasible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a reda::ted copy of your response that deletes such information, if you request withholding of such OFFICIAL RECORD COPY
