The Committee To Review Generic Requirements (CRGR) met on Tuesday, October 6,1998, i

from 9:00 a.m. to 11:30 a.m. Attachment 1 contains the list of attendees.

T. Essig and D. Cleary, both of NRR, presented to CRGR for review and endorsement the proposed rule titled " Changes to Requirements for Environmental Review for Renewal of i

Nuclear Power Plant Operating Licenses (10 CFR Part 51)." Attachment 2 contains the staff's presentation materials. The Committee was previously briefed on this rulemaking at CRGR Meeting No. 207, held on May 28,1991).

I The CRGR comments and recommendations are summarized as follows.

1 Clarify that the scenario of transporting fuel through Las Vegas is not planned, rather there are reasons to assume that any truck shipments would bypass the city. The Committee was concerned that the staff did not clearly explain that routing. Furthermore, other assumptions do not represent the most likely scenarios. Therefore, the Committee recommended that the discussion section should contain a better explanation of this conservatism and how it relates to the best estimate calculations.

In the revision of paragraph (M) of 10 CFR 51.53, clarify that the candidate site.at Yucca Mountain should be used for the purpose of impact analysis as long as that site is under consideration for licensing.

In Table S-4 of 10 CFR 51.52, the calculated cumulative dose values of 18,000 person-rem to the general public and 24,000 person-rem to transportation workers will be perceived by the public as being large. The Committee recommended that the staff explain how conservative are these estimates compared to the best estimate, and compared to the cumulative estimates for Las Vegas.

Explain why Table S-4 values continue to be valid.

CRGR was also concemed about the staff's use of ultra conservative upper bound estimates, instead, the Committee would like to see more emphasis placed on the best estimates. The Committee recommended that the staff's clearly communicate to the public that these estimates are very conservative. Additionally, the Committee recommended that population within an appropriately large geographic area be used in dIl7g' g~(d the RADTRAN accident analysis.

A red-line strike-out version of the rule package was received on October 16,1998. Due to time constraints, the CRGR staff did not review revisions to the companion documents, NUREG-1437, Supplement 1. " Generic Environmental Impact Statement for License Renewal of N.uclear Plants: Supplemental Analyses for Cumulative Environmental Impacts of Spent Nuclear Fuel Transport and implications of Higher Bumup Fuel for the Conclusions in 10 CFR 51.52, Environmental Effects of Transportation of Fuel and Waste - Table S-4,' Draft for Comment."

However, review of the revised rulemaking package identified an additional clarification which was deemed necessary to resolve the Committee's comment no. 4. With resolution of this and previously noted other comments, as well as with the understanding that the staff has made conforming changes to NUREG-1437, on October 21,1998, the Committee endorsed the draft final version of the rulemaking package (Attachment 3) for issuance.

In accordance with the EDO's July 18,1983 directive conceming " Feedback and Closure of CRGR Review," a written response is required from the cognizant office to report agreement or disagreement with the CRGR recommendations in these minutes. The response is to be fonvarded to the CRGR Chairman and if there is disagreement with the CRGR l

recommendations, to the EDO for decision making.
