MY Allegation Review and Assessment Status Hi folks-This is intended to provide you all with the current status and some logistical info. I hope I have managed to send this to everyone who needs to get it. If not, the omission was i

unintentional and please let me know and I'll resend.

1. Description of this effort is TAC NO. M94194, Allegation No. NRR 95 A-0072, Maine Yankee cales for ECCS/SB LOCA l 2. Team members are:
a. Bill Long, Containment Systems Branch, OWFN
b. Summer Sun, Reactor Systems Branch, OWFN
c. Dan Moy, DRS, Region I

. d. Dennis Boal 01, Region IV 4

e. Ed Trottier, PM, OWFN i

in addition, we will have two representatives of the State of Maine as observers. They are:

a. Uldis Vanags, State Nuclear Safety Advisor (Augusta)
b. Pat Dostie, State Nuclear Safety inspector (Plant)

The team is expected to arrive a'ound 12:45 to 13:00 on Monday,11 Dec at YAEC

  • Headquarters. YAEC is located at I-495 Exit 27 (Mass Rt.117) about.oneduarter:. rnite OUTSIDE l-495 beltway. We will have a presentation by YAEC at 13:00 to start things off. It
is expected that they will give their results to date of allinformation, data searches, supporting documentation, and independent evaluations that YAEC has performed in response to this allegation. After presentation, it may be useful for team to meet and work out a plan. I
believe YAEC intends to assign us experts in the various disciplines of interest to answer any questions and/or produce any documents we may desire. These YAEC folks will NOT be the same ones who produced the original body of work, but are independent YAEC employees who are knowledgeable and who have been working on the allegations.. Of course, the
original YAEC employees will be available to us for historical or technical purposes.

We are expected to contact NRR in the attemoon daily to give a progress report. Point of contact will be Bob Jones. YAEC management (their MY Proj. Mgr is Pete Ande son) would also like an aftemoon meeting to review the day and plan out what they may need to have

ready for us the next day.

4 Logistics: Summer, Bill and I are flying US Scare into Boston Logan. We leave from Dulles at 10:00 and arTive 11:23 (good Lord willin' and the creek... bay... don't rise). Directions ara Mass Tumpike (90) WEST to I-495, which is Exit 11. NORTH on 1-495 to Exit 27. Go outside Beltway on Rt.117 about 1/4 mile. See YAEC driveway on left.

NEM0RANDUM TO: DOCKET FILE 50-309, MAINE YANKEE ATOMIC POWER COMPANY FRON: E. H. TROTTIER, NRR PROJECT MANAGER FOR MAINE YAN PANY SUBJ: TELECON BETWEEN NRR AND MAINE YANKEE ATOMIC POWER This documents the telephone conference call and discussion between William T.

Russell (Director, NRR) and Charles D. Frizzle (President and CEO of Maine Yankee Atomic Power Company), which was held between 10:55 and 11:05 a.m. (ET)

(approximate timos) on Wednesday, December 20, 1995.

Mr. Russell placed the call to Mr. Frizzle, and the following two topics were discussed:

1. Reactor criticality and operation of Maine Yankee Atomic Power : station Mr. Russell asked--and Mr. Frizzle agreed--that
a. The Maine Yankee reactor would not be made critical until a duly authorized representative of Maine Yankee Atomic Power Company has discussed plans for criticality and subsequent operations '.vith a duly authorized representative of the NRC's Office of Nuclear Reactor Regulation, and the duly authorized NRC representative has agreed to such criticality and subsequent operations, or
b. The U.S. NRC has taken other action related to the use of proprietary computer code RELAP5YA at Maine Yankee Atomic Power Station. These other actions would include, but not be limited to, a determination that RELAP5YA is not used in any analysis or application that could impact plant conditions during Operating Cycle 15 (begins with the next reactor criticality and plant startup).
2. NRC's Order preventing criticality and startup of Maine Yankee Mr. Russell advised Mr. Frizzle that the specific form of NRC's pending Order stating conditions under which Maine Yankee may make its reactor critical and return to power operations is subject to continuing discussion within the NRC.

Mr. Russell noted that in the public meeting held on Monday, December 18, 1995, between the NRC and Maine Yankee Atomic Power Company, it was stated that the pending Order would be a Confirratory Act hn Letter te set forth the conditions under which criticality and operation to 2440 MWt vould be permitted, followed by a Ccnfirmatory Action Order that would describe the conditions under which the hRC would permit reactor operation up to the currently licensed power level of 2700 MWt. The specific form of comunication of the above-noted conditions may be a Show Cause Order.

The determination of the specific form of communication to be used is under discussion within the NRC and had not yet been decided at the time of this telephone conference call.

This telephone conference call was concluded at approximately 11:05 a.m. (ET).

The NRR Project Manager for Maine Yankee was in attendance during this call.
