October 17, 1986 SERVED OCT 'l01986 ORDERl (Ruling on Newbury Request for Reconsideration of Board's Order of September 11,1986)
By letter dated October 15, 1986 addressed to the Chairperson of this Board, the Chairman of the Newbury Board of Selectmen, Angie Machiros, requested that consideration be given to allow responses to the Applicants' interrogatories of April 28, 1986. We treat this letter as a motion for reconsideration of our Order of September 11, 1986 imposing modified sanctions.
The basis for TON's request is that the Applicants' interrogatories could not be located in their files and that if served, they were served 1
Copies of Newbury's March 10, 1983 Request To Participate as an Interested Municipality and this Board's Order of March 18, 1983 admitting Newbury as an interested municipality are enclosed.

The Board has exanined the Certificate of Service attached to the Applicants' Off-Site EP Interrogatories and Request For The Production of Documents To City of Newbury, MA (Set No.1). This certificate reflects that one of Applicants' attorneys on April 28, 1986 made service of these interrogatories on Mr. Angie Machiros, Chairman of the Board of Selectmen, Town of Newbury, Newbury, MA 01950 by depositing a copy of the interrogatories with Federal Express, prepaid for delivery to Chairman Machiros who is also the author of this letter of request for reconsideration.
The Board finds no bases that warrant further consideration of Newbury's request.
The Board affinns its Order of September 11, 1986 insofar as it concerns The Town of Newbury.
