APPENDIX A NOTICE OF VIOLATION UNC Naval Products Docket No.70-371 Montville, Connecticut License No. SNM-368 As a result of the inspection conducted on March 3-7, 1986, and in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following violations were identified:

A. Section 2.6.1.2 " Authorizations", Part 1 (Criteria) of your NRC-approved license application, dated March 28, 1977, states, in part, that all SNM processing, handling and storage areas shall be posted with the authorized criticality safety limits.

Contrary to the above, on March 3, 1986, a work bench used for the processing and handling of SNH, located in the Building B-North electron beam welding area, was not posted with the authorized criticality safety limits.

This is a Severity Level V violation (Supplement VI.E)

B. License Condition No. 9. of License No. SNM-368, dated February 27, 1985, states that the authorized places of use of SNM are the licensee's existing facilities at Montville, Connecticut, as described in the referenced application. Section 1.2.2 of the NRC-approved license application entitled "The Facilities," states, in part, that operations conducted at the Montville site are located in the buildi.ngs designated on Drawing No. E-740913-150, Revision 1, dated August 22, 1983.

Contrary to the above, on March 3-7, 1986, the inspector observed that the licensee had constructed and initiated use of the Building M component inspection room extension and the component storage building east of Building M and south of the East Building. In addition, the licensee had initiated construction of a new waste handling and storage building to the south of Building B. None of these new buildings or additions are

. designated, on Drawing No. E-740913-150, for use of SNM.

This is a Severity Level V violation (Supplement VI.E)

C. 10 CFR Part 20.201(b) states that each licensee shall make or cause to be made such surveys as (1) may be necessary for the licensee to comply with the regulations-in this part, and (2) are reasonable under the circumstances to evaluate the extent of radiation hazards that may be present. 10 CFR 20.106(a) states, in part, that a licensee shall not possess, use or transfer licensed material so as to release to an unrestricted area radioactive material in concentrations which exceed the limits specified in Appendix B, Table II of this part.

Appendix A 2 Contrary to the above, on March 5-6, 1986, the inspector observed that the samplers on the decontamination area, the sectioning area and the Health Physics hood stacks were not correctly located to properly evaluate the extent of radiation hazards that may be present and to assure that the limits specified in Appendix B, Table II for release of material to unrestricted areas are not exceeded.

This is a Severity Level IV violation (Supplement VI.D)

D. Section 2.5 " Operation Control, Part 1 (Criteria) of your NRC-approved license application dated March 28, 1977, states, in part, that NPD Management shall require that suitable control measures are prescribed and that all pertinent regulations, controls, or procedures relative to radiological safety are followed. Section 2.5.2, " Operational Procedures", states that specific operational procedures shall be set up to control the handling of special nuclear material.

Contrary to the above, on March 5, 1986, the inspector determined that the licensee had not established operational procedures to control the handling of shoe covers, contaminated with special nuclear material, during the sorting and laundering process, and suitable control measures had not been prescribed to establish limits for and measure residual contamination on laundered shoe covers.

This is a Severity Level IV violation (Supplement VI.D).

Pursuant to the provisions of 10 CFR 2.201, UNC Naval Products is hereby required to submit to this office, within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
