o 7590-01 NUCLEAR REGULATORY COMMISSION Docket No. 50-352 PHILADELPHIA ELECTRIC COMPANY Limerick Generating Station, Unit 1 RECEIP1 0F PEQUEST FOR ACTION UNDER 10 CFR 2.206 Notice is hereby given that the Director of Nuclear Reactor Regulation is con-sidering as a request for action under 10 CFR 2.206 a letter dated March 5, 1986, from Robert L. Anthony. Mr. Anthony contends, on the basis of the licensee's applications to the Delaware River Basin Commission (DRBC) concerning the with-drawal of cooling water from the Schuylkill River, that the plant has been operated in violation of the plant's Environmental Protection Plan. Mr. Anthony further contends that on this basis the operating license for Unit 1 should be suspended. A decision will be made on Mr. Anthony's request within a reasonable time. A copy of the letter is available for public inspection in the Commission's Public Document Room at 1717 H Street, N.W., Washington, DC 20555, and in the local public document room at the Pottstown Public Library, 500 High Street, i

We received an answer, dated 2/26/86,from H.R.Deston stating that there was no need for the NRC to act on our petition ami that he did not in-toed to issue "a formal Director's Daoision".

The statements above from PEco provide the evidemoe of actions in violation of App. B by PRCo during 1985, changing the withdrawal criteria from temperature to Disolved Oxygen, flow limit,and reassignment of water alloostions from,other plaats.

These changes have extensive environmental impact and are forbidden in App. E, copecially Para.3 1,which concerns operations " significantly affect (ing) the cavironment" and involving "an unreviewed environmental question".

NRR. The present application violates the conditions set forth in App.B 3 1 :

Before engaging in additional construction or operational activities which may significantly affect the environment,the licensee shall prepare sun record an environmental evaluation of such activity.....

When the evaluation indicates that such activity involves an unreviewed envi-rommental question, the licensee shall provide a written evaluation of such activity and obtain prior NRC approval.

Then such activity involves a change in the EPP,such sativity and change to the EPP may be implemented only in accordance with as appropriate license amendment as set forth in Section 5 3 of this EPP.
