LETTERS FROM THE PUBLIC CONCERNING THE I LOUISIANA ENERGY SERVICES PROCEEDING 1

in COMNJD-97 006, Commissioner Diaz recommended prompt service of Congressionalletters containing ex pfjie material. The Office of the Secretary intends j to follow this approach. A requirements memorandum to that effect is in preparation.

The Louisiana Energy Services (LES) proceeding brings up another matter about which I would like to keep you informed. SECY is in possession of 702 form postcards and letters principally addressed to the Chairman, with a few letters addressed to other Commissioners, concerning the ' proceeding. The proceeding was initiated in 1991 before an Atomic Safety and Licensing Board. In 1995, form postcards and letters  ;

addressed to Chairman Jackson and to members of the Licensing Board, b,egan  !

arriving from members of the public living near the proposed site for the LES Claiborne enrichment facility. This correspondence generally favored denial of the application of LES for the enrichment plant.

The LES Licensing Board Chairman, Thomas Moore,in developing an approach to deal j

with the many hundreds of cards and letters received by the Board, determined that the '

correspondence should be considered under 10 CFR 2.715 as limited appearance statements. After the LES Board issued the Final Initial Decision (LBP-97-08), Judge Moore in a memorandum to the Secretary forwarded 2,311 cards and letters received by the Board and asked that they be placed in the LES docket. Copies of the forwarding memorandum were served on the LES parties. ,

Postcards and letters similar to those sent to Judge Moore but which are addressed to the Chairman or the Commission are being handled as follows: they are placed on the docket, provided to the appropriate staff, placed in the Public Document Room (PDR),

and individually acknowledged by SECY. They are not served on the parties. They are held in the official docket where they may be viewed by the parties and your offices as ,

2 official docket material. Following the lead of Judge Moore, we intend to provide a count of the correspondence received to the parties at the close of the proceeding.
