Gentlemen:
This letter it, in reply to your December 10, 1986 letter to Mr. J. B. Martin
of this office in which you responded to our Notice of Violation dated
i
November 17, 1986, (Report No. 50-397/86-30).
In regards to violation B you stated you did not acknowledge the validity'of
,
'
the violation.
Despite the immediate reporting of the security incident to a
security supervisor by a member of your. guard force you stated the supervisor
was under the impression that proper compensatory measures had been taken and
therefore no reporting of the incident to the NRC under 10 CFR 73.71(c) was
required.
Several days later an investigation by your staff revealed that
compensatory measures were not adequate and that the supervisor had erred in
his conclusion that proper measures had been taken.
The basis of your denying the validity of the violation is that you define the
time of discovery of the event being reportable as June 12, 1986, seven days
after the incident.
We consider the time of discovery as the time on June 5,1986 when your
security supervisor was apprised of the incident by the security guard.
We
cannot accept the supervisor's error of disregarding an assessment by a
security staff member as a valid excuse for not meeting the NRC reaorting
requirement.
Your security supervisors are expected to be thoroughly
knowledgeable of security requirements.
It concerns us that your supervisor,
realizing the complexity and confusion occurring as a result of the June 5th
security problems, did not seek confirmation of the validity of his decision
concerning the adequacy of the compensatory measures.
We are pleased to note, however, that your internal investigation has clearly
noted the inappropriateness of the compensatory measures taken during the
incident.
Your response to violation A appears adequato and your corrective
actions for both violations A and B will be reviewed dueing subsequent
inspections.
