Dear Andy:

I was pleased to hear that your appointment as NRC' State Liaison Officer for the Western States has been confirmed.

We are looking forward to a productive' relationship. Once you are successfully relocated to the San Francisco area, I hope we can establish fairly frequent contact.

Our Executive Secretary, R. N. Fitch, has talked to you by telephone about attending the Council's special meeting November 16, in Richland. I hope you will be able to join us, not only to get better acquainted with the Council and its functioning, but also to share with both the Council and the public attending this meeting a brief overview of the NRC review status for the WPPSS Projects (2,1 and 4) in the Richland area.

As you know, I was appointed by the Governor as the first full-time Chairman of the Council on October 1, of this year.

One of my major concerns as a full-time Chairman is to strengthen federal-state cooperation in the energy facility siting area. I hope that as soon as you are settled we can begin working in an organized way toward cooperative agree-ments with NRC. In the meantime, several matters concerning NRC actions which are troublesome to the Council have come to my attention. I would like to mention these now in the expectation that some corrective action can be taken as soon as possible.

The first of these issues relates to a letter (copy attached) dated October 20, 1977 from Henry J. McGurren, NRC Staff Counsel concerning WPPSS Nuclear Project Nos. 3 and 5. My first concern is that we received the letter on October 25, 1977 which announced a NRC site visit to the project site on the following day, October 26, 1977. One day notice was simply not sufficient to call on the Council or its staff to participate in the site review. If more lead time on the written notice was no.t possible, then the Council should have been contacted by telephone as soon as the NRC visit was scheduled.

-contact by NRC with the Washington State Division of Geology.

NRC~'should be aware that Washing ~ ton State statutes give their Council exclusive state jurisdiction over all energy facility siting, construction and operation matters. In the future, all contacts with agencies of Washington State Government regarding. projects under the jurisdiction of the. Council v/ should come through the Council. Following contact from NRC,

) we will make every effort to secure any assistance or consul-tation from state agencies which NRC may desire. Again, telephon3 contact will be fine, if this will assist in meeting target time schedules. I am .sure you understand that the state has everg wish to cooperate fully with NRC but must do so in an orderly and coordinated fashion The second issue relates to a notice (copy attached) from the NRC office of Nuclear Reactor Regulation concerning the ACRS

' meetings held in Portland, Oregon October 26 and 27, 1977.

I am concerngd_that the Council received formal written notice of these on Octhser 24, 191/. In my view, this no tice was no t sufficient to allow the Council to make adequate arrangements to be present. I further note that while the meeting was .

  • specifically held to review certain matters pertaining to the Pebble Springs Nuclear Plant (Oregon) and the Skagit Nuclear-Plant.(Washington), the notice also indicates that the meeting was to review matters concerning the WPPSS Nucle'ar Project No. 2:(Washington) and the WPPSS Nuclear Project Nos. 3 and 5

, (Washington). Given the substantial consideration of projects located within the State of Washington, I find it difficult to understand the location of this meeting in a Rodeway Inn, on 82nd Avenue in Portland, Oregon. This location certainly makes it difficult for interested officials and citizens of the State of Washington to attend a meeting which is devoted to projects located in Washington State. In the future, I would urge the NRC to locate such meetings in a more central location or to schedule meetings for Oregon projects in Oregon and Washington projects in Washington.

I will appreciate your comments as to how we may be able to avold the type of problems I have referenced above, in the future.
