Dear Mr. Grimsley:

Pursuant to the Freedom of Information Act, the New England Coalition on Nuclear Pollution ("NECNP") requests that you make available at the Commission's Public Document Room at 1717 H Street, NW, Washington, D.C., copies of documents in the follow-ing categories:

A.

All documents, reports, and studies which form the basis for NUREG-0956's conclusion that the Ma rk I containment would fail in nine out of ten types of severe accidents, as reported in the Wall Street Journal, July 22, 1986, p.5, "NRC to Repor t G. E. Containment System...", in a statement attributed to Wayne Houston, Deputy Director of the Boiling Water Reactor Division.

This request in-cludes but is not limited to all documents used to prepare the draf t and final reports of NUREG-0956.

B.

All post-operating license documents containing an analy-sis or evaluation of the containment and/or related systems of the Vermont Yankee reactor, and all updates, appendices, addenda, supplements, and other changes thereto.

C.

All documents containing discussions, analyses of, and for reports on the significance of the Chernobyl-4 reac-tor accident for U.S.

containment designs, and all up-dates, amendments, appendices, addenda, supplements, and all other changes thereto, including but not limited to the following documents:

The study is referenced in a letter to Harold Denton f rom J.

Gary Weigand, dated June 30, 1986, Pursuant to 10 C.F.R. 9.14a(c), please waive the fees for searching and reproduction of the documents requested above.

As discussed below, this request meets the Commission's six-part standard for waiver of fees:

1) NECNP engages in activities to educate the public, and has a longstanding history of participation in licensing cases, i.e.,

Vermont Yankee and Seabrook.

The information requested will be used in NECNP's public education activities, includir publica-tion in newsletters to members of the Coalition and interested members of the public.

NECNP may also use the information in proceedings to determine the safety of Mark I containments.

2) The size of the public that will be benefitted by.the dis-closure includes all members of NECNP and members of the public affected by the operation of Mark I reactors.

This is a large group, considering the large number of Mark I's in operation.

3) Dissemination of the requested information will benefit the public by increasing the public's awareness of possible safety hazards associated with the operation of Mark I reactors.

The release of the requested information is essential to increas-ing the public's ability to make informed judgements about nuclear power and its possible consequences.

An informed public voice will encourage the operation of nuclear plants which are safe and efficient.

4) The requester will receive no financial benefit since it is a nonprofit organization.
5) As a nonprofit organization funded principally by member contributions, the requester has very limited ability to pay for any of the anticipated costs.
6) For the reasons provided in paragraphs (1),(2), and (3),

the intended use of the requested materials will contribute sub-stantially to public debate on an important policy issue, i.e.,

whether continued operation of Mark I reactors is safe.

For the foregoing reasons, the NRC should grant the request to waive fees for searching and reproduction of documents relat-ing to the adequacy of the Mark I containment.

I look forward to receiving your response within ten working days, as required by the Freedom of Information Act.
