ENCLOSURE 1 NOTICE OF VIOLATION Vermont Yankee Nuclear Power Corporation Docket No. 50 271 Vermont Yankee License No. DPR 28 During the NRC Inspection conducted from June 1 to July 19,1997, two violations of NRC requirements were identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violations are listed below:

1. Technical Specification 3.7.A.7.b requires that, within the 24 hour2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> period subsequent to placing the reactor in the RUN mode following a shutdown, the containment atmosphere oxygen concentration shall be reduced to less than four percent and maintained in this condition.

Contrary to the above, the reactor was placed in the RUN mode at 8:20 p.m. on May 7,1997, but atmosphere oxygen concentration in the torus air space remained greater than four percent until the morning of May 12,1997, a period of approximately four and one half days.

This is a Severity Level IV violation (Supplement 1)

2. 10 CFR 50, Appendix B, " Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants," Criterion XVI, " Corrective Actions," states that,

" measures shall be established to assure that conditions adverse to quality, such as f ailures, malfunctions, deficiencies, deviations, defective material and equipment, and non conformances are promptly identified and corrected."

Contrary to the above, during the period June 1 to July 19,1997, the inspectors substantiated that appropriate mer::ures were not being implemented to assure prompt identification and correction of several conditions adverse to quality, including:

1. five seismic hangers in the containment air dilution system that were found not to be properly adjusted; li, a one quarter inch gap that was found between the end battery cell and the selsmic support rack for one of 16 groups of cells in the "A" un interruptible power supply battery; iii. a conduit to class 1E junction box B 504 Si that was found to be missing the first unistrut clamp from the junction box, and class 1E conduit 11186E Sll that was missing two adjacent unistrut clamps; and, iv. cracked caps that were found on the positive terminal of four cells in the un-Interruptible power supply batteries indicating deterioration of the terminal's electrolyte seals, t

Pursuant to the provisinns of 10 CFR 2.201, Vermont Yankee Nuclear Power Corporation is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region 1, and a copy to the NRC Resident inspector at '

the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a

" Reply to a Notice of Violation" and should include: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response, if an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to l extending the response time.
