  • ENGLQ1UEE_1 NOTICE OF VIOLATION

-Entergy Operations, Inc. Docket No.: 50-382-Waterford Steam Electnc Station, Unit 3 License No.: NPF-38 EA No.: 97-403 During an NRC inspection conducted on June 29 through August 9,1997, violations of-_

NRC requirements were identified in accordance with the " General Statement of Policy-and Procedure for NRC Enforcement Actions," NUREG-1600, the violations are listed below:

A. - 10 CFR SO,65(a)(1) states, in part, that each holder of an operating license shall-monitor the performance or condition of structures, systems, or components, .

against licensee established goals and such goals shall be established commensurate with safety, 10 CFR 50.65(a)(2) states, in part, that monitoring under paragraph (a)(1) is not l required where it has been demonstrated that the performance or condition of a l

structure, system, or component is being effectively controlled through the performance of appropriate preventive maintenance such that the structure, system, or component remains capable of performing its_ intended safety function. Paragraph -

(c) states, "[t]he requirements of this section shall be implemented by each licensee no later than July 10,1996."

Contrary to the above, ~as of January 1997, for the emergency lighting system, the licensee:-(1) f ailed to establish goals commensurate with safety as described in -

10 CFR 50,65(a)(1); or (2) as an alternative, failed to demonstrate that the performance of the above specified system was effectively controlled through the performanca of appropriate preventive maintenance and that the system remained capable'of performing its intended function in that neither the unavailability of the-function performed by the system was monitored nor an acceptable alternative-method for compliance proposed.

This is a Severity Level IV violation (Supplement 1)(50-382/9715-03).

- B. - 10 CFR Part 50, Appendix R, Section Ill(J), states that emergency lighting units with at least an 8-hour battery power supply.shall be provided in all areas needed for operation of safe shutdown equipment and in access and egress routes thereto.

Safety Evaluation Report, Supplement 8, Section 9, and Updated Final Safety >

Analysis Report, Table 9.5.1'-4, both indicate that the chilled water system is required for safe shutdown following a fire.

Contrary to the above, as of August 9,1997, emergency lighting units with at least an 8-heur battery power supply were not piovided for the reactor auxiliary building .

This is a Severity I.evel IV violation (Supplement l} (50 382/9715 06).

Pursuant to the provisions of 10 CFR 2.201, Entergy Operations, Inc. is hereby required to submit a written statement or explanadon to the U.S. Nuclear Regulatory Commission, ATTN:- Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a cooy to the NRC Resident inspector at the f acility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notico). This reply should be clearly marked as a % ply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the. corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. -Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an

adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Whete good cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be p! aced in the PDR without redaction. However, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis to support your request for withholding the information from the public.
