NRC/OIE Inspection Report 50-369/86-31 and 50-370/86-31 Gentlemen:

In response to NRC Staff concerns regarding our radioactive materials shipping program as a result of IE Inspection Report 50-369/86-31 and 50-370/86-31 (with accompanying Notice of Violation dated November 26, 1986), Duke has reviewed its program with the following results. The program is effective, with corrective cetion being required at a rate of less than one in one thousand shipments, however, the program is not faultless as corrective action has been required at all. Duke's program is routinely audited by our Quality Ase,urance Department, and cny findings are promptly resolved. It is not possible, *:owever, to predict all potential incidents, thus isolated incidents may occur, as did the subject viola-tion. When such an incident occurs, it is Duke Power's policy to fully and promptly investigate the event, and address full corrective actions (for all Duke nuclear stations, as applicable) to the incident. Duke believes that this sort of continual review of the program contributes to the effectiveness of our shipping program and will continue to apply this approach.

Duke would like to comment on existing policy and procedure for NRC Enforcement Actions in the area of transportation (10CFR 2. Appendix C, Supplement V).

Present policy dictates that a breach of package integrity constitutes a Severity Level III violation. Duke Power agrees that a breach of package integrity war-rants a violation, but Duke believes that the NRC Staff should be given additional flexibility in enforcement in such matters, i.e., a breach of package integrity in itself should constitute a Severity Level IV violation. Should the breach of i

package integrity result in contamination or result from negligence, a Level III violation would be in order.
