Dear Mr. Frazee:

l As requested, we have reviewed the proposed regulations (WAC 246-220,246-221,246-232, 246-235 and 246-244; new chapter 246-231) - requirements for transportation, areas of j

exclusive Fedsral jurisdiction, dose constraints on air emissions, and disposition of

. decommissioning records, with an August 9,1999 effective date. These were submitted by your June 11,1999 letter. In addition, we reviewed the proposed wording for Section WAC

{

246-221-005 related to air emissions that you submitted to the NRC by facsimile on July 6,

.1999. The proposed regulations are in response to the four amendments identified in the enclosed Regulations Assessment Tracking System (RATS) Data Sheet. The regulations were reviewed by comparison to the equivalent NRC regulations in 10 CFR Parts 20,30,71,150 and

' Part T of the Suggested State Regulations for Control of Radiation.

As a result of our review, we have no comments. Please note that we have limited our review to regulations required for compatibilit/ and/or health and safety. Under our current procedure, a finding that a State regulation meets the compatibility and health and safety categories of the equivalent NRC regulation may only be made based on a review of the final State regulation.

However, we have determined that if your proposed regulations were adopted without significant change, they_would meet the compatibility and health and safety categories established in OSP Procedure SA-200. In addition, Mrs. Linda McLean discussed our review of the regulations with you on July 15,1999. Specifically, she discussed Section WAC 246-221-005 with you, and determined that the proposed wording of that Section, as submitted, would be compatible with NRC's regulations.

We request that when the proposed regulations are adopted and published as final regulations, a copy of the "as published" regulations be provided to us for review. As requested in OSP Procedure SA-201, Review of State Reaulations (November 10,1998), please highlight the final changes and send one copy in a computer readable format, if possible.

We have also summarized on the RATS Data Sheet our knowledge of the status of other 5

Washington regulations. Please let us know if you note any inaccuracies or have any comments on the information cont.ained in the RATS Data Sheet.

Many NRC licensees possess source, byproduct, or special nuclear material in a form that would not cause doses to members of the public from releases of airborne radioactive maiorial to the environment. These l

lleensees include radiographers, well loggers, and other users of sealed sources. These licensees need not take any actions to demonstrate compilance with the constraint on releases of altbome radioactive materlata s'a##/tfM to the om4ronment.
