Dear Ms. Tefft:

Given the significance of the revised 10 CFR Part 20 rule to both NRC and Agreement State programs, NRC undertook a review of all Agreement State final Part 20 equivalent rules for compatibility with 10 CFR Part 20. The review was conducted as a two step process. The first step involved a review by Oak Ridge National Laboratory (ORNL), under contract with NRC, to identify any differences or inconsistencies between 10 CFR Part 20 and each Agreement State equivalent rule. A copy of the two volume ORNL report, dated -

August 7,1995, documenting its staff review of the New Hampshire final Part 20 equivalent rule, is enclosed for your information and use (Enclosure 1). The second part of the review was conducted by NPC staff and consisted of a review of the differences and

inconsistencies identified by ORNL for compatibility and adequacy significance.

The NRC review focused on those provisions of your rule that are required for compatibility or for health and safety under the new adeouacy and compatibility policy statement approved by the Commission by Staff Requirements Memorandum dated June 30,1997 (Enclosure 2 describes the new compatibility categories). Enclosure 3 provides our comments on the State's regulations and shows the current compatibility divisions (i.e.,1

, and 2) and the corresponding new compatibility categories (i.e., A, B, C, D, NRC, and H&S). There are two provisions, as noted in Enclosure 3, that are not cc,mpatible with 10 CFR Part 20.

Within 45 days, we request that you res;.und in writing with information describing the actions you plan to take to address our comments. As you are aware, Agreement States 4

have flexibility to adopt rulcs required for compatibility in the form of legally binding requirements other than regulations. This methodology may be appropriate to resolve compatibility issues rairad with New Hampshire's regulations.  ?

1. 4003.01(m) Definition "ALARA" (Division 1)

New Hampshire omits " consistent with the purpose for which the licensed [or registered] activity is undertaken, taking into account the state of technology, the economics of improvements in relation to benefits to the public health and safety, and other societal and socioeconomic considerations, and in relation to utilization of nuclear energy and licensed [or registered] sources of radiation in the public interest." This phrase is necessary for compatibility because it sets forth the criteria to be taken intc account to maintain exposures to radiation as far below the dose limits as is practical.

2. 4003.01(ca) Definition
  • Member of the Public" (Division 1)

' New Hampshire omits "However, an individualis not a member of the public during any period in which the individua! receives an occupational dose." By omitting this sentence, New Hampshire does not exclude individuals receiving occupational doses from the scope of this definition.

3. 4020.08 " Determination of intemal exposure" (Division 1)

New Hampshire uses the word "or" instead of"and" at the end of 4020.08(h)(2). This change alters the acceptable criteria for determining which radionuclides in a mixture may be disregarded.

4. 4022.09 " Control of Sources of Radiation not in Storage" (Division 2)

New hampshire adds the phrase "or in a patient" to the end of 4022.09(a). This addition is incompatib'c with the final SSR and 10 CFR Part

New Hampshire omits "The class (D,W, or Y) given in the column headed " class" applies only to inhalation ALis and DACs given in Table I, columns 2 and 3." This omission is incompatible with the final SSR and 10 CFR Part 20.
