Investigation No. 50-278/1-85-019 Enclosed is a Report of Investigation concerning alleged threats to employees to prevent disclosure of possible overexposure information to the NRC. The investigation sought to determine if the employment of a Bartlett Nuclear Inc.

(BNI), contract Senior Health Physicist (HP) was terminated at the Peach Bottom Atomic Power Station (PBAPS) as a result of his engaging in a protected acti-vity. A second objective of this investigation was to determine if the BNI HP was " blackballed" following his termination from PBAPS when he attempted to gain employment at another nuclear facility. The investigation disclosed that the BNI HP did have legitimate concerns stemming from an incident which took place in the PBAPS, Unit 3, recombiner offgas tunnel on March 1, 1985. A summary of the investigation was provided to you by letter dated May 20, 1986 and an enforcement conference was held with your staff on May 30, 1986. At the timo of this enforcement conference there was a question of whether or not you had all the facts needed to fully respond to the safety concerns of the NRC.

Accordingly, the investigative report and its exhibits are being provided at this time.

When you have reviewed the attached report and are prepared to discuss its findings please contact us for the purpose of scheduling a second enforcement conference.

In accordance with 10CFR ?. 790(a), a copy of this letter and the enclosure will be placed in the NRC Public Document Room unless you notify this office by telephone, within ten days of the date of this letter and submit written application to withhold information contained therein within thirty days of the date of this letter. Such application must be consistent with the requirements of 2.790(b)(1). The telephone notification of your intent to request withholding, or any request for an extension of the 10 day period which you believe necessary, should be made to the Supervisor, Files, Mail and Records, USNRC Region I, at (215) 337-5223.
