Dear Mr. Davis:

Caro'ina Power & Light Company (CP&L) hereby provides clarification relative to 2

Special Nuclear Material (SNM) License No. SNM-1939 for the Shearon Harris Nuclear Power Plant (SHNPP).

The SHNPP SNM license was issued via Reference 2 on the basis of information contained in the CP&L license application (Reference 1).Section IX, Fire Safety, of the Safety Evaluation Report attached to Reference 2 cited specific statements from page 8 of the CP&L SNM license application (attached); however, it did not cite the concluding sentence which states: "The manual hose stations and portable extinguishers located in the vicinity of the new fuel storage and new fuel inspection areas will be installed prior to rece'pt of new fuel." This sentence provides CP&L's commitment for fire protection prior to receipt of new fuel and is consistent with CP&L's position to comply with Branch Technical Position CMEB 9.5-1, Section C.7.1.

It remains CP&L's intention to comply with the stated commitment for new fuel receipt and to complete the remainder of the commitments for fire protection features prior to issuance of an operating license (OL). In the event that equipment required to comply with the commitment for storage of new fuel prior to receipt of an OL is inoperable, CP&L will provide a 24-hour fire watch at the 286' elevation of the Fuel Handling Building (FHB) until the equipment is operable. After receipt of an OL, the technical specification requirements for fire protection in the FHB will apply.

CP&L has a separate commitment, independent of the SNM license, to comply with Branch Technical Position CMEB 9.5-1, Section C.1.e(l). CP&L will establish a 24-hour fire watch at the FHB 286' elevation in lieu of compliance with CMEB 9.5-1, Section C.I.e(l), until a 3-hour rated fire barrier is completed for this area. The 3-hour barrier is essentially complete, with the exception of approximately 100 electrical penetrations for which cable pulls are not complete. A distance of approximately 19 feet exists between the nearest electrical penetration and the new fuel area. It is anticipated that the 3-hour boundary will be installed with electric$.pe r 'on ec t

Mr. John G. Davis LS-86-140/Pagm 2 The use of a fire watch provides an equivalent level of fire safety for new fuel on the basis of the enhanced capability to detect and respond to a fire. CP&L believes that the clarifications and commitments in this letter are consistent with the Safety Evaluation Report which supports the SHNPP SNM license, and in no way affects the safety of the Harris Plant.
