.,..M ENCLOSURE 1 NOTICE OF VIOLATION i

Carolina Power and Light Company Docket No. 50-324 Brunswick License No. OpR-62 The following violation was identified during an inspection conducted on March 17-21, 1986. The Severity Level was assigned in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C).

10 CFR 50.55(g)(5) requires that the inservice inspection program for a boiling or pressurized Water-Cooled nuclear power facility be revised as necessary, to meet the requirements of paragraph (g)(4) of 10 CFR 50.55a.

If the licensee determines that conformance with certain Code requirements is impractical for his facility, the licensee shall notify the commission and submit information to support his determinations. As a result of the above requirements the licensee had upgraded the Inservice Inspection program for Brunswick Unit 2, to encompass the following three editions of the ASME Code; 1970, 1974575, and 1977S78.

The 1970 edition of the Code was used for the Unit 2, first outage of the first inspection period. The licensee subsequently upgraded the Inservice Inspection (ISI) Program to the 1974575 Edition and Addenda for the second outage of the first period and further updated the ISI program to the 1977S78 Edition and Addenda for the second and third period examinations of the first 10 years inspection interval.

Class 1 component requirements for the 1970, 1974S75, and 1977S78 Editions and Addenda of the ASME Code required that except for examinations specifically allowed by the Code to be deferred to the end of the inspection interval, at least 16% of the required examinations shall have been completed by the expiration of one-third of the inspection interval (with credit for no more than 34% if additional examinations are completed) and at least 50% shall have been completed by the expiration of the two-thirds of the inspection interval (with credit for no more than 67%). The remaining required examinations shall be completed by the end of the inspection interval.

The Class 2 component, period requirements delineated in the 1977 edition of the ASME Code are identical to the Class 1 period requirements described above. Class 2 period requirements delineated in 1974 Edition of the ASME Code simply state: "To perform at least part of the required examinations by the expiration of one-third, two-thirds and the end of each inspection

' interval."

Carolina Power and Light Company 2 Docket No. 50-324 Brunswick License No. DPR-62 Contrary to the above, examinations for Class 1 Categories B-G-2 and B-K-2 components and all Class 2 components were not performed by the licensee until the third inspection period of the first 10 year inspection interval.

This is a Severity Level V violation (Supplement I).

Pursuant to 10 CFR 2.201, you are required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged violation; (2) the reasons for the violation if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved.

Security or safeguards information should be submitted as an enclosure to facilitate withholding it from public disclosure as required by 10 CFR 2.790(d) or 10 CFR 73.21.
