NOTICE OF VIOLATION (NRC Investigation Report No. 3 96-037)

Dear Mr. Fertill:

This refers to an NRC Office of Investigations (01) Report of investigation No. 3-96 037 concerning the circumstances surrounding your violation of NRC requirements while working as a technician in the Control and instrumentation (C&l) department at Clinton Nuclear Power Plant (CNPP). A synopsis of the investigation is enclosed.

Based on the Ol investigation, the NRC has determined that you engaged in deliberate misconduct in violation of 10 CFR 50.5 which caused CNPP to be in violation of 10 CFR 50.9 when you deliberately falsified a data sheet. The violation is cited in the enclosed Notice of Violation (Notice). A copy of these NRC regulations are enclosed.

On May 29,1996, you and another individual were assigned to perform preventive maintenance (PM) on the Division 11 shutdown service water system. The PM included verification that a backwash valve remained open for 2 minutes and 18 seconds + 10/ 0 and if the timer tolerance was not met adjustment was allowed, in this instance, the timer tolerance was not met, and no adjustment was made to bring the timer into conformance with the tolerance limits. According to the Single input Calibration Sheet, the "as found" data was documanted as 2 minutes and 14 seconds. On May 30,1996, the supervisor interviewed both you and the other individual concerning the unacceptable datat During the course of that discussion you changed, in the presence of the supervisor, the previously recorded data to 2 minutes and 18 seconds, a value that was within tolerance, without performing an instrument calibration. Changing the data in this manner was a deliberate act of record falsification. As a result of these actions, your employment at the CNPP was terminated.

l As an individual engaged in NRC licensed activities, you were in e position that conferred upon you trust and confidence in your ability to ensure that activities were conducted in accordance with NRC requirements, and information required to be maintained by NRC requirements was complete and accurate in all material respects. T. Ferrill 2-falsification of the data on the Single input Calibration Sheet is of regulatory concern because it did not adhere to these standards. Therefore, af ter consultation with the Director, Office of Enforcement, I have decided to issue the enclosed Notice for a violation of 10 CFR 50.5 while you were engaged in licensed activities at CNPP.

You should be aware of the seriousness with which the NRC views your actions. The public health, safety, and trust demand that nuclear power plant personnel conduct themselves with integrity at all times. You did not conduct yourself in this manner in this case. In the future, any similar violation may result in more significant enforcement actions, including removal from NRC licensed activities.

You are not required to respond to this letter. However, if you choose to provide a ro:,ponse, please provide it to me in writing and under oath within 30 days at U.S. Nuclear Hegulatory Commission, Region ill,801 Warrenville Road, Lisle, Illinois 60532.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, records or documents compiled for enforcement purposes are placed in the NRC Public Document Room (PDR). A copy of this letter with your address removed, the Notice and your recponse, if you chnose to submit one, will be placed in the PDR af ter 45 days unless you provide sufficient basis to withdraw this letter and the Notice.
