SUBJECT:

Telecon with Alleger-Uniontown Landfill AMS No. RIII-94-A-0026 At the request of Gary Shear, Mike McCann and I called the alleger on July 20,.

-1994. The alleger contacted Gary Shear by phone on or around July 15, 1994 and complained about how the NRC was handling her allegations. Gary was unsure exactly what her complaints =re, other than stating that "we" made certain promises that'we are not keeping.

On July 20, 1994 @ 2:00 p.m. Mike and I called her to find out what her specific complaints were. She specifically asked for a copy of the memo from the Region III Office of Investigations (01)'to the U.S. EPA IG, which referred her complaints of wrongdoing to the EPA IG's office. I checked with Gene Pawlik to see if this was "0K" and he said to go ahead and send it to l her. I faxed it to her,the following day (7/21/94). The remainder of the conversation involved five specific questions which were:

(1) When the Canton Beacon Newspaper contacts us, will we confirm to them that the !?RC has referred allegations of wrongdoing -to the EPA IG's Offita ?

(2) .She discussed in great detail about statements made to her by the Deputy Secretary of Energy, Tom Grumbly regarding the site. Ihis item was not a specific question and did not pertain to the NRC.

(3) Will we confirm the wrongdoing allegations were refer' red to the EPA IG if someone contacts the NRC ? (this was similar to question #1)

(4) Are we going to write a rebuttal to the EPA's draft SAB report, if not why not ?

(5) Could.we interpret the water and soil laboratory data taken from EPA contractors and the Ohio Department of Health and compare it to NRC sites ?

We did not, answer her questions and requested that she write us a letter and ask these questions and we will respond to those quest' ions with a written response. We explained to her that we must ask for her questions in writing so there is no misunderstanding, that way'both the NRC and her' organization fully understand the issues.

b; On July 25, 1994 we received a fax from the alleger (2 pages + cover), see attachment A, that states that she is concerned and distressed tha.t the NRC continues to refer.to her as an alleger and that the NRC provided her name to the media during an-interview with a reporter. The remainder of the f,1x questionsvariousallegedstatementsmadetoherinthepastbythestaf/. -

These issues will be addressed in.a letter to~ her which is currently being drafted.
