ORDER PROHIBITING INVOLVEMENT IN NRC LICENSED ACTIVITIES (EFFECTIVE IMMEDIATELY)

Dear Mr. Nelson:

The enclosed Order Prohibiting Involvement in NRC Licensed Activities (Effective Immediately) is being issued because of your deliberate misconduct in violation of 10 CFR 50.5 of the Commission's regulations. Specifically, the Nuclear Regulatory Commission (NRC) Office of Investigations (01) found that, on January 3,1996, you deliberately falsified a quality assurance (QA) document describing the replaceAnt of a valve gasket at Duke Power Company's McGuire Nuclear Plant. The 01 synopsis is enclosed. 01 concluded that you purposely decided to reuse the old gasket and intentionally signed the procedure step claiming that you had replaced the valve gasket.

Furthermore, during the investigation, you were not forthright in providing information regarding the failure to follow procedures and intentional falsification of the record as evidenced by statements made by you to the 01 investigator.-

Based on your actions, the enclosed Order prohibits your involvement in NRC licensed activities for a period of one year and requires you to notify the NRC of your first involvement in NRC licensed activities for a period of one year following the prohibition period.

Pursuant to Section 223 of the Atomic Energy Act of 1954, as amended, any person who willfully violates, attempts to violate, or conspires to violate, any provision of this Order shall be subject to criminal prosecution as set forth in that section. Violation of this Order may also subject the person to civil monetary penalty.
