Our letter to you dated May 3,1985, requested that your Corporation remit the $150 application fee for 30ur October 31, 1984 request for certain penetrations to be exempted from compliance with the modified definition of Containment Integrity aad be required to meet the FSAR criteria for TMI-2.
In a letter dated May 21, 1985, you' stated that this application was not subject to fees since you expected it to be approved by an amendment of order to clarify a previous NRC order issued pursuant to 10 CFR 2.204.
Due to the uniqueness of the TMI-2 case which resulted in the issuance of the February 11, 1980 Order, almost all approvals are required to be done by amendment of this order. - Consequently, the issuance of an amendment of order, as well as any modification of an order, is con-sidered to be a substitute device for the ordinary and regular manner of issuing amendments to the license and associated Technical Specifications.
Therefore, under the special circumstances of the TMI-2 case, your October 31, 1984 application is not exempt from fees. Your Corporation will be billed for the review of it in the next invoices issued for the billing cycles ending June 22 and December 21, 1985. This application was approved on July 8,1985, and was not considered to be clarifying in -
nature.
