NATIONAL MINING ASSOCIATION URANIUM RECOVERY WORKSHOP ON aUNE 1-3,1999
Dear Ladies and Gentlemen:
On June 1-3,1999, the Nuclear Regulatory Commission, Division of Waste Management staff held public meetings with representatives of the Nationr.1 Mining Association, the uranium recovery industry, and affected States, in Denver, Colorado. The purpose of these meetings was to provide a forum for the attendant organizations to discuss pertinent issues within the uranium recovery industry. Enclosed is a summary of the meeting minutes, with attached copies of the attendance lists and the individual presentations and associated handouts. The next meeting is tentatively scheduled for next summer, if you have any questions conceming this subject, please contact me at (301) 415-6631.

MINUTES FROM THE JOINT NUCLEAR REGULATORY COMMISSION -
NATIONAL MINING ASSOCIATION URANIUM RECOVERY MEETING ON JUNE 1-3.1999 On June 1-3,1999, the U. S. Nuclear Regulatory Commission staff from the Division of Waste Management, (Uranium Recovery and Low-Level Waste Branch (URLL)), the Division of Accounting and Finance (DAF), and Region IV met with representatives of the U. S. Department of Energy (DOE), Nuclear Energy institutes (NEI), uran:um recovery industry and the National Mining Association (NMA) in Denver, CO. The purpose of this meeting was to provide a forum for the attendant organizations to discuss pertinent issues within the uranium recovery industry.
The sessions began on Tuesday moming, June 2,1999, with informalintroductions by Ms. Katie Sweeney (NMA) and Dr. N. King Stablein (NRC). Dr. Stablein also introduced Mr. Jchn Surmeier as the newly appointed Branch Chief, Uranium Recovery and Low-Level Waste Branch. This was followed by a series of presentatior.s by NRC staff which included:
NRC's Status and Update of Activities; Commission Papers99-011,99-012, and 99-013; an update on proposed rulemaking activities. Performance Based Licenses, and the NRC Proposed Fee Rule for FY99.
Presentations were made by members of the uranium industry which included Mr. Richard Blubaugh, President of the Atlas Corporation, who gave an update on the status of the Atlas site. Views on the Altemate Feed Paper were presented by Mr. D&ve Frydlenlund of the Intematio'la! Uranium (USA) Corporation.
On Jur'a 1,1999, the session consisted of NRC's presentations on the Decommissioning rule for Uraniun; Hecovery Facilities, Standard Review Plan for Reclamation of Title 11 Sites, guidance on Erosion Protection, NRC Streamlining Initiatives, and Inspecting Performance Based Licenses.
Mr. Clifton Farrell(NEI) gave a presentation on Part 70 and Part 41 Rulemakings. Mr. George Hellstrom, a representative from Envirocare gave his viewpoints on Staff Papers. Mr. Emie Scott, a representative from Bear Creek gave a presentation on Achieving ACL Approval.
The Department of Energy representatives, Mr. Russell Edge and Dave Mathes gave presentations on the Site Transfer Process and the Status of Title X.
Enclosed as Attachment 1 is the list of meeting attendees for both days and Attachment 2 provides the final agenda for the meetings, and copies of the slides and related handouts presented at the workshop.
In summary, both NRC and the workshop participants agreed that these periodic meetings continue to be useful for exchanging information and discussing the status of uranium recovery program activities and concems of licensees. The next joint NMA/NRC is tentatively being planned for the summer of 2000.

NRC ISSUES LICENSE AMENDMENT APPROVING STABILIZATION PLAN FOR ATLAS URAN!UM MILL TAILINGS PILE IN UTAH for the Atas Corporation to stabilize in place its uranium mill tailings The tailir";s pile resutted from operations of a uranium mill at the Moab site from 1956 until 1984. The facility has been owned by Atlas since 1962. Uranium is no longerprocessed at the site, and the mill has been dismantled except for one building.
The Atas plan includes (1) re-grading the tailings to enhance drainage off the pile and (2) installing an earth and rock cover system over the pile. This cover system is intended to minimize radon escape, infiltration of rain water into the tailings (thus minimizing infiltration of tallings contaminants into the groundwater), and tailings erosion potentially caused by surface runoff from rain or flooding of the Colorado River.
The NRC issued a draft environmental impact statement on the proposal for public comment in January 1996 and held public meetings in Moab in April 1994, February 1996, and September 1998 to discuss the proposal. The agency issued a Final Environmental Impact Statement on the plan in March.
The NRC also issued a final technical evaluation report in March 1997, which concluded that Atlas' plan to dispose of mill tailings on site met NRC technical requirements.

NRC and Ground Water The Industry contends that NRC's regulation of ground water is duplicative of ground-water protection programs required by the Safe Drinking Water Act and administered by the US Environmental Protection Agency or EPA-authorized States.

The Industry's proposed solution for addressing duplicative regulation is for the NRC to determine it does not have authority over activities in ISL wellfields.
