Dear Congresswoman Oakar:
Thank you for your letter of January 28, 1986, to Chairman Palladino.
He has asked me to respond.
The various hearing requests regarding low-level radioactive waste disposal at the Davis-Besse nuclear power station, that were the subject of your letter, currently are pending before the Commission.. Initially, the Commission must resolve the legal status of those hearing requests under section 189a of the Atomic Energy Act of 1954, 42 U.S.C. S 2239(a).
This statutory provision governs the circumstances in which the Commission must convene a hearing relating to an agency licensing action.
If the Commission concludes that no hearing is required under section 189a, the question of whether a hearing should be convened, as a matter of discretion because it is in the public interest, then would have to be answered.
Concerns such as those expressed in your letter undoubtedly will be given consideration by the Commission in making such a determination.
When the Commission issues an order concerning the requests for a hearing on the Davis-Besse low-level waste disposal authorization, I will see that a copy is sent to you.
In the meantime, I have asked Paul Bollwerk of my staff (at 634-3224) to be available for any questions regarding the status of this matter.
