SUBJECT:
RESPONSE TO CONGRESSIONAL INQUIRY REGARDING DISPOSAL GF LOW-LEVEL RADIOACTIVE WASTE AT DAVIS-BESSE
.By letter dated January 28, 1986, Congresswoman Mary Rose Oakar expressed concern about the agency's action authorizing the disposal of low-level radioactive waste at the site of the Davis-Besse nuclear plant and suggested that public hearings be held.

In a response dated February 19, 1986, Judge Plaine indicated to Representative Oakar that the Commission had under consideration various hearing requests relating to the disposal proposal and that we would inform her when an order was issued.

Subsequently, we received a telephone call from Andrew Fedynsky of Representative Oakar's staff (225-5871) who requested that the agency respond to the Congresswoman's suggestion in her January 28 letter that disposal should only take place consistent with the recently passed Midwest Interstate Low-Level Radioactive Waste Compact.
Because this inquiry raises policy questions concerning the specific options considered by the staff in'authorizias the disposal at Davis-Besse, I believe that it would be better if staff provide a direct response to the Congresswoman's office on this issue.
If you agree, we will inform Representative Oakar that we have referred this matter to. staff for response.
