We have reviewed the final Washi.1gton regulations (Equipment performance requirements, WAC 246-243-040; Leak testing, repair, tagging, opening, modification, and replacement of sealed sources, WAC 246-243-090; Determination of prior occupational dose, WAC 246-221-020, which became effective on July 9,1998; and Financial assurance and recordkeeping for

' decommissioning, WAC 246-235-075, which became effective May 3,1997). The request is based on your May 26 and 27,1999 e-mails. We also reviewed our letter to you dated May 28, 1997 that covered the financial regulation. The final regulations ar6 in response to the three amendments identified in the enclosed Regulation Assessment Tracking System (RATS) Data Sheet. The regulations were reviewed by comparison to the equivalent NRC regulations in 10 CFR Parts 19,20,30, 34,40 and 70. We also discussed our review with you on July 1, 1999.

As a result of the NRC review, we have identified two comments, as enclosed. We suggest you consider these comments in future changes to your regulations to help meet the compatibility and health and safety categories established in OSP Procedure SA-200.

We have, also summarized on the RATS Data Sheet our knowledge of the status of other Washington regulations. Please let us know if you note any inaccuracies or have any comments l

WAC-246-221-020 20.2104 1995-5 Determination of prior occupational dose.

Because the State has chosen to adopt

" planned special exposure," the compatibility designation for this section is category C.

Paragraph (1) of WAC-246-221-020 implies that occupational dose can only be received in a restricted area. However, paragraph (a) of 20.2104 does not depend only on whether or not the individual may enter a restricted area of the licensee.

We suggest that you consider changing the j

text, for example: "For each individual who enters the licensee's or registrant's restricted areas or is likely to receive, in a year, an occupational dose requiring monitoring..."

H&S WAC-246-235-075 30.35 1995-6 Financial assurance and recordkeeping for decommissioning.

There is some uncertainty whether or not the essential objectives of 10 CFR 30.35(b)(2) are l

met because the term " certification" is not used in sections (4) and (5).

The insertion of the phrase,

  • Submit a certification that," in provision (4) would remove the uncertainty. The sentence would read: " Submit a certification that financial assurance for decommissioning sha'l be l
