n e r--n i 1 A n rm entrnm61A" Uni LUUn;wd liit V T V N Ul SEP 191905 Docket No. 50-440 The Cleveland Electric Illuminating Company ATTN: Mr. Robert M. Ginn President Post Office Box 5000 Cleveland, OH 44101 Gentlemen:

This refers to the special safeguards inspection conducted by Ms. G. M. Christoffer of this office on July 9, 1986, of activities at the Nuclear Power Perry Plant authorized by NRC Operating License No. NPF-45 and to the discussion of our findings with Mr. F. Stead and other members of your staff at the conclusion of the inspection. This was also discussed with Mr. M. Edelman of your staff at a meeting on August 14, 1986, in the Region III office.

The special inspection was conducted regarding a Safeguards Event reported by a member of your staff on June 27, 1986. During this inspection, certain of your activities appeared to be in violation of NRC requirements, as specified in the enclosed Notice. A written response is required.

The violation (Item I) described in the Notice of Violation to this letter represents a breakdown in your security access control system. We view this breakdown as significant. Had the plant status been different we would have considered classifying the event as a Severity Level III violation. This particular violation; however, is being classified at Severity Level IV due to the plant status at the time of the event and the difficulty of obtaining access to the area. A direct threat to the health and safety of the public did not specifically exist.

Areas examined during this inspection concern a subject matter which is exempt from disclosure according to Part 73, Title 10, Code of Federal Regulations, Section 73.21(c)(2). This infomation must be handled and protected in accordance with the provisions of 10 CFR 73.21. Consequently, the enclosure to this letter and your response to the violations identified in the enclosure to this letter will not be placed in the NRC Public Document Room. Therefore, your statement of corrective action regarding the violation (s) identified in the enclosure should be submitted as a separate enclosure to your transmittal letter in the manner prescribed.
