By letters dated September 16, 1986 and October 28, 1986, the Nuclear Regulatory Comission (NRC) staff informed you of their partial approval of your application dated January 25,1984, and issued Amendment Hos. 46 and 49 to License No. DPR-77 and Amendment Nos. 38 and 41 to License No.
DPR-79 for the Sequoyah Nuclear Plant Unit Nos. I and 2, respectively.
This application proposed certain Technical Specification changes filed in response to Generic Letter Nos. 83-30 and 83-37. Fees pursuant to 10 CFR 170.22 of the March 23, 1978 regulations were not submitted with your application since the Authority determined the application was exempt from fees under Footnote 2 to 10 CFR 170.22 because it was filed in response to Comission requests.
Based on information provided by the NRC staff, (it has been determined that a Class IV fee ($12,300) and a Class I fee $400) are appropriate for those changes submitted in response to Generic Letter No. 83-37 since the review will involve consideration of several safety issues and a duplicate unit. When applications such as this are requested for enhancing the safe operation of a nuclear facility or to correct a problem or potential problem relating to the operation of the facility, they are not exempt under Footnote 2 of 10 CFR 170.22 of the March 23, 1978 regulations because they are not for the purpose of simplifying or clarifying the license or TS for the convenience of the NRC. However, the TS changes submitted in response to Generic Letter No. 83-30 are exempt from fees under Footnote 2 since they were requested for the purpose of simplifying and clarifying the license or TS for the con-venience of the NRC and had no safety significance.
