SEABROOK STATION, UNITS 1 AND 2 DOCKET NOS. 50-443 AND 50-444 L

INTRODUCTION By letters dated March 26,1986. June 2,1986, July 22,1986, and September 2, 1986, Public Service Company of New Hampshire requested an amendment to Construction Permits Nos. CPPR-135 and CPPR-136 to permit ownership interest

' transfers for the Seabrook Station, Units 1 and 2.

EVAt.UATION Amendment No. 9 to Construction Permit Nos. CPPR-135 and CPPR-136 permits the transfer of an aggregate ownership share in the Seabrook Station, Units 1 and 2, of 12.13240% to EUA Power Corporation from Bangor Hydro-Electric Company (2.17391%), Central. Maine Power Company (6.04178%), Central Vermont Public Service Corporation (1.59096%), Fitchburg Gas and Electric Company (0.86519%), Maine Public Service Company (1.46056%).

Issuance of Amendment No. 9 would delete the utilities listed above as owners on the construction permits and add EUA Power Corporation as an owner.

Additional antitrust information was submitted by Public Service Company of New Hampshire as required by 10 CFR Part 50, Appendix t..

This information was precipitated by the proposed transfer of ownership shares of the Seabrook Station, Units Receil t of Additional Antitrust 1 and 2 to EUA Power Corporation.

i Information; Time for Submission of Views on Antitrust Matters was published in the Federal Register on May 23, 1986 (51 FR 18982) offering additional information to the public or having their views on this matter presented to the Attorney General by July 22, 1986. No requests were received.

' A financial cualification review of EUA Power Corporation was performed by James Petersen of the Office of State Programs pursuant to the provisions of 10 CFR 50.33(f) and 10 CFR 50.80 requiring a financial qualifications review and findings regarding the new owner prior to the Amendment of the Construction Permits.

It was concluded that EUA Power Corporation demonstrated reasonable assurance that they can obtain the necessary funds to purchase the proposed ownership interests'.

ENVIRONMENTAL ASSESSMENT Pursuant to 10 CFR 51.32, the Commission determined that the issuance of Amendment No. 9 to Construction Permit Nos. CPPR-135 and CPPR-136 will have no significant impact on the environment. The issuance of Amendment No. 9 is strictly for deletion and addition of owners from the Construction 3

Permits.

In addition, the staff has determined that Amendment No. 9 to the Construction Permits involves no significant increase in the amounts, and no significant change in types, of any effluents that may be released offsite, and that there is no significant increase in individuals or cumulative occupational radiation exposure. The Commission has determined that the amendment involves no significant hazards considerations. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9).

Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of this amendment.

CONCLUSION e

Amendment No. 9 to Construction Permit Nos. CPPR-135 and CPPR-136 is strictly administrative in nature for the purpose of transferring ownership shares I

only. No technical conditions have been added or deleted from the Construction Permits. The staff concludes that:

(1) the prosposed amendment to Construction Permit Nos. CPPR-135 and CPPR-136 permitting the transfer of share ownership does not. involve a significant increase in the prnbability or l

consequences of accidents previously considered, does not create the possibility of an accident.of a type different from any evaluated previously, does not involve a significant decrease in a safety margin, and thus does not involve a significant hazards consideration; (2) there is reasonable assurance construction and operation in the proposed manner; and (3)gered by that the health and safety of the public will not be endan such activities will be.in compliance with the Commission's regulations, and the issuance of the amendment will not be inimical to the common defense and security or to the. health and safety of the public.
