We are enclosing for your information a copy of the new amendments j

to 10 CFR Parts 50, 70, and 73, published November 6, 1973, in the

Federal Register (Enclosure 1).

In the interests of common defense j?

and security and of public health and safety, new requirements are prescribed to strengthen the protection of certain licensee plants h

i and special nuclear materials. The new requirements pertain to transportation security, facility security, and material control

and accounting.

The new regulations require that existing plants be backfitted to

) i i l meet the new protection requirements and that licensees submit their protection plans for approval. The plans must show how licen-1 sees will meet one new requirements. Licensees must follow their protection plans after the dates specified in the new amendments even though they may not yet have been specifically approved by the Atomic Energy Commission. No changes which would decrease the effectiveness of the protection programs can be made without prior approval of the AEC.

Following AEC approval, the protection plans will be incorporated in licenses as technical specifications or license conditions.

E General guidance for the preparation of the required protection plans 5

is presented in Enclosure 2.

Specific guidance for material control E7 and accounting, facility protection, and transportation protection is E

provided in Enclosures 3, 4, and 5, respectively. We believe that g

this assistance will simplify and expedite both the preparation and the review of the required protection plans.

E Any request for an exemption or exception from a specific requirement E

in the new regulations must be submitted separately from the licensee's

protection plans. A detailed justification must be presented for

each such request. An exemption or exception request must be pre-E pared in a manner suitable for public disclosure.

On November 1,1973 the Environmental Surveillance Program serving the NUMEC Apollo and Parks Township Sites was adjusted to permit increased sensitivity while deleting non-productive activities. The adjustments

]

were based upon evaluation of the five (5) years of data that has been collected via implementation of an "Evaluative Network". The adjust-ments provide a " Permanent Network" for the established sites, while leaving unchanged the "Evaluative Network" for the new NUMEC Type II Facility.

Attachments to this letter permit comparisons between "Evaluative" and

" Permanent" sample types, sample numbers, sample durations, sample frequencies and routine sensitivities. Sample preparations and analyses, and instrumentation considerations, continue to be essentially those described in Section 6

" Effluent and Environmental Measurements and Monitoring Programs" - of the NUMEC Type II Facility Environmental Impact Report (SNM-414; Docket 70-364).

The scope of the attached Environmental Surveillance program is consistent with the philosophy as presented in the SNM-145 and SNM-414 renewal applications presently being reviewed by your group.
