APPENDIX A NOTICE OF VIOL / TION Aerotest Operations, Inc. License No. R-98 Docket No. 50-228 As a result of the inspection conducted during the period of January 5-8, 1987 and in accordance with NRC Enforcement Policy 10 CFR, Part 2, Appendix C, the following violations were identified:

A). Technical Specification, Section 3.2 requires-that the alarm system installed to detect unauthorized entry shall be tested monthly and Technical Specification, Secticn 7.1 requires that the installed fixed gamma radiation monitoring instrument annunciation and siren actuation system shall also be tested monthly.

Contrary to the above, the monthly tests prescribed under Sections 3.2 and 7.1 were not performed for the following periods:

1). January 18, 1985 to April 5, 1985 2). April 29, 1985 to June 11, 1985 and 3). April 3, 1986 to June 2, 1986 This is a Severity Level IV Violation (Supplement 1).

B). 10 CFR Part 50.54(q) states in part: "...A licensee authorized to possess and/or operate a research reactor or a fuel facility shall follow and maintain in effect emergency plans which meet the requirements in Appendix E of this part."

Section IX, " Maintaining Emergency Preparedness" of the licensee's emergency plan establishes the following requirements:

1).

...A training / refresher course shall be given on an annual basis and will be attended by all Aerotest Operations personnel...."

2). " Drills shall be conducted on a randomly timed, twice yearly basis during the monthly tests of the various alarms."

3). "The Emergency Plan shall be reviewed on a Biennual basis."

Contrary to the above, 1). No training was conducted in 1985 and the 1986 training did not include two permanent and two temporary Aerotest Operations personnel.

2). Only one drill was conducted in each 1985 and 1986.

3). The last review of the Emergency Plan was, conducted two and one half years ago on July 20, 1984.

This is a Severity Level IV Violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, Aerotest Operations, Inc. is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation addressing each alleged violation and including: (1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
