a APPLICATION FOR EXEMPTION 3-FROM.THE REQUIREMENTS OF 10 CFR 70.24-Niagara Mohawk Power Corporation hereby requests exenption from the requirements of.10lCFR 70.24, Criticality Accident' Requirements, for its Nine Mile Point Unit 2 (Docket.70-2948) facility. Such an exemption request is.

orovided for. by 10 CFR_70.24 (d). -lhe request is justified by the inherent features associated with_the. storage and inspection of unirradiated fuel containing uranium enriched to less'than 5 w/o U-235 and the administrative-controls that will be.in effect during the transfer, inspection, and storage of. fuel.at NMP2. The granting of the requested exemption.will not endanger life, proper'ty, or the common defense and security, is'otherwise in the public interest,_ and is' authorized by law (10 CFR 70.14).
