NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 70-1113/86-22, REV. 1)

This refers to the Nuclear Regulatory Commission (NRC) Operational Safety Assessment conducted by J. B. Kahle and other members of the team on October 6-10, 1986. The inspection included a review of activities authorized for your Wilmington facility. At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the enclosed inspection report.

Areas examined during the inspection are identified in the report. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations of activities in progress.

The inspection findings indicate that certain activities appeared to violate NRC requirements. The violation is described in the Notice of Violation which is enclosed as Appendix A. This violation and your corrective actions were l addressed in your letter of February 20, 1987 after the report was sent to you i for proprietary review in accordance with 10 CFR 2.790. We reviewed your l corrective actions, found them acceptable, and acknowledged our acceptance in a letter dated March 6, 1987. No additional response concerning the violation is required.

The findings of this inspection also indicate that weaknesses exist in some aspects of your operational safety program and that there are program areas which should be evaluated and considered for improvement. These are discussed in l

Appendices B and C which are titled " Operational Safety Assessment Weaknesses" and " Operational Safety Assessment Improvement Items" respectively.

We recognize that explicit regulatory requirements pertaining to each item

! identified in Appendices B and C may not currently exist. Notwithstanding this,

! you are requested to submit to this office the following information by April 29, 1987:

1. the actions you have taken or plan to take on the weaknesses specified in Appendix B, and l 2. the results of your consideration of each of the improvement items l

specified in Appendix C.

APR 141987 General Electric Company 2 The enclosed inspection report documents an oral commitment (see paragraph 2) made by a licensee representative during the exit interview. If your under-standing of this commitment differs from the report statements, please inform this office promptly.

In accordance with your letter of March 27, 1987, material which you identified as company proprietary in accordance with 10 CFR 2.790(b)(1) has been removed. In accordance with 10 CFR 2.790(a), a copy of this letter and its enclosures will be placed in teh NRC Public Document Room.

The responses directed by this letter and its enclosures are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
