I am happy to have this opportunity to respond to your letter of August 25, 1986, requesting a clarification of the type of meeting to be held in our office on September 17, 1986, and the level of management expected to be in attendance.

As I am sure you are aware, the proposed violations identified by our staff are considered Severity Level IV. The Enforcement Policy clearly provides for enforcement conferences for Severity Level IV violations which, if repeated, could lead to escalated enforcement action.

The discussion held on August 14, 1986, between our respective staffs appears to have resulted in a misunderstanding. We were aware that your staff wanted to meet to discuss the health physics prrblems; however, my staff informed them that a management meeting may be redundant since a decision to hold an enforcement conference was under consideration. I am not aware of any perception from my staff that Wisconsin Electric is not open and forthright in their communications Under normal circumstances, the Regional Administrator or Deputy Regional Administrator attends enforcement conferences; however, the Pegional Administrator may delegate this task to Division Directors depending on the significance of the issues. In this instance, my staff and I felt that attendance of the Regional Administrator or his Deputy was unnecessary because escalated enforcement action was not being considered for the proposed violations. Mr. Keppler concurred and directed that I lead the enforcement conference. We likewise feel it is not necessary for Senior Management of Wisconsin Electric Power Ccepany to attend this enforcement conference; however, if ycu choose to attend, you are certainly welcome.
