This will acknowledge your letter of January 15, 1987 which responded to the Nuclear Regulatory Consnission's Notice of Violation and Proposed Imposition of Civil Penalty dated December 17, 1986.

In the Notice we expressed our concern that the scope of Illinois Power Company's corrective actions appeared to focus on the prevention of intimidation and discrimination regarding Quality Assurance / Quality Control personnel, and we indicated that this scope should be broadened to include the prevention of discrimination against all personnel who engage in protected activities and not just QA/QC personnel. We have evaluated your response to this concern.

The programs you have in place and actions taken to disseminate appropriate policy throughout the company's work force, appear acceptable. However, we will continue to monitor this area in the course of future inspections.

We have also considered your denial of the violation and your request for a stay of the civil penalty pending final action by the Department of Labor and any judicial review. We hereby suspend the civil penalty proceeding in this matter pending resolution of this case before the Department of Labor and any subsequent judicial review. We will consider your denial that a violation occurred at that time. Should the appeal process be lengthy, we reserve the right to reconsider this deferral decision.
