I prefer option 1.
As I have said in the past, I do not believe that the Comission itself should rule on whether a party has presented a material issue of fact. That is what we have licensing boards for.
I do not believe we should begin a rulemaking to change the requirement to a two year requirement rather than a one year requirement.
