SUBJECT:

ALLIED CHEMICAL HEXAFLOURIDE CONVERSION PLANT In your memorandum to me of October 31, 1986 you asked for my response to three questions regarding the treatment of the Allied Chemical hexaflouride conversion plant at Metropolis, Illinois, in conjunction with the Illinois application for Agreement State status.

Under the Agreement proposed by the State of Illinois, regulatory and 11-censing jurisdiction over the Allied Chemical hexaflouride conversion facility at Metropolis, Illinois, would be relinquished to the State by virtue of the State's assumption of regulatory authority over source material.

Dear Governor Thompson:

Thank you for your letter of;0ctober 2, 1986 in which you propose to enter into an agreement with the Nuclear Regulatory Commission under which NRC would discontinue, and Illinois would assume, regulatory authority over certain sources of ionizing radiation in Illinois.

As Mr. Kerr, Director of the Office of State Programs discussed with Ms. Witter of your staff, I have asked the NRC staff to' provide the Commission with additional information related to's transferring to the State of Illinois regulatory authority for the Allied Chemical plant in Metropolis.

Meanwhile, the staff is preparing an assessment of the State's proposal and will publish it in,the Federal Register inviting public comment.

A public announcement concerning your proposal will be made at that time.

Your proposal will be acted upon by the Commission.

after the expiration of a 30-day public comment period.

We will then inform.you promptly of our action.
