APPENDIX A NOTICE OF VIOLATION Brigham Young University (BYU) Docket: 50-262/87-01 Nuclear Laboratory License: R-109 .

During an NRC inspection conducted on February 2-3, 1987, violations of NRC requirements were identified. The violations involved: (1) failure to perform Technical Specification surveillances, (2) failure to perform a biennial review of the security plan, and (3) failure to properly secure a security door. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions, "10 CFR Part 2, Appendix C (1986), the violations are listed below:

A. Failure to Perform Surveillances Technical Specifications (TS)Section II, " Operational Limitations and Restrictions," states that the following surveillances will be performed:

Section II.C, Surveillances:

2. The safety circuits in Table I, items 7 and 8, shall be checked to be operable at least annually.

(Items 1, 3, and 4 only apply during operation of the reactor.)

5. Control rod drop times shall be measured at least semiannually.
6. A calibration measurement of control rod worths shall be performed at least annually.
7. A calibration measurement of the power measuring channels shall be performed at least annually.

Contrary to the above, the NRC inspector determined on February 3, 1987, that the licensee had not performed the required safety system surveillances since May 11, 1982.

This is a Severity Level IV violation. (Supplement I)(262/8701-01)

B. Failure to Perform the Biennial Review of the Physical Security Plan 10 CFR Part 73 requires ~that each licensee shall implement and maintain a Physical Security System.

The BYU Reactor Facility Security Plan,Section II.E, dated October 7, 1974, requires that, "The Facility Chief, in consultation with the Reactor Safety Committee, shall review the Facility Security Plan not less frequently than once every two years."

that the Facility Security Plan had not been reviewed since May 1982. ]

This is a Severity Level V violation. (Supplement III)(262/8701-02)

C. Failure to Properly Secure Nuclear Laboratory Door 10 CFR Part 73 requires that each licensee shall establish and maintain a Physical Security System.

The BYU Reactor Facility Security Plan,Section II.B.2, dated October 7, 1974, requires that during non-working hours, the entrance door to the Nuclear Laboratory shall be locked and the burglar-aiarm system shall be in operation.

I Contrary to the above, the NRC1 inspector determined during initial entrance into the Nuclear Laboratory on February 3, 1987, that the primary access door to the Nuclear Laboratory was not locked shut.

This is a Severity Level IV violation. (Supplement III)(262/8701-03)

Pursuant to the provisions of 10 CFR 2.201, Brigham Young University is hereby required to submit to this office within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation: (1) the reason for the violation if admitted, (2) the corrective steps which have been taken and the results achieved, (3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
