DOMESTIC SHIPMENTS OF STRATEGIC SPECIAL NUCLEAR MATERIAL

Purpose:

To inform the Commission of a: situation that leaves the private-sector without a qualified carrier to transport shipments of strategic special nuclear material (Category I) on the domestic leg of export shipments.

Background:

On May 22, 1986, Transnuclear, Inc., White Plains, NY, informed-the NRC that Tri-State Motor Transit Company, Joplin, M0 would no longer act as its carrier of Category I material. Tri-State has been the only qualified carrier in the private sector providing transport from point of origin in the U.S. to the point of a

transfer to foreign military aircraft at aerial ports of embarkation. All exports have originated at Department of Energy (DOE) facilities at either Piketon, OH or Oak Ridge, TN and have been transported to the Port of Columbus, OH airport (French exports) or to Dulles International Airport, VA (German shipments).

Although there is no present impact on domestic commercial shipments, a potential long rang'e problem exists related to the shipment of high enriched reactor fuel to Ft. St. Vrain in 1988.

00E transports all Category I shipments for the U.S. Navy Program.

Discussion: Staff has contacted a number of DOE offices regarding the situation, including the Office of Nuclear Non-Proliferation Policy (Office of International Affairs), the Office of Safeguards and Security and the Transportation Support Division.

The Department of State has also been informed. Transnuclear, Inc. has requested DOE to provide the domestic surface transportation for future exports. They have advised that DOE requested them to advertise in a national trade newspaper to determine if there were any other companies interested in this business. Advertisements were run from May 30 through June 5, 1986 in the Journal of Commerce and on June 9,1986 in Transport Topics.

Exports of Category I quantities of strategic special nuclear material cannot be assured until such time as either a decision is made by DOE to provide the domestic transporta tion of these shipments or a private company is identified that can meet NRC regulations. The latter appears unlikely for a number of reasons. For example, Tri-State Motor Transit Company withdrew from this service because the low number of shipments did not justify the bullet-resistant cabs for the trailers, the special training of guards under 10 CFR Part 73 or the administrative costs associated with maintaining cleared guards and others associated with the shipments. The first export shipment to be impacted will be the proposed shipment from Piketon, OH to Columbus, OH to Paris, France (via French military aircraft).

This shipment is tentatively scheduled for June or July. A second shipment, scheduled for August, involves the movement of material from Piketon, OH for transfer to German military aircraft at Dulles enroute to Germany.

Status:

Transnuclear is presently awaiting responses to its advertise-ments in trade publications.

If no qualified bidders respond by June 21, 1986, they will so inform DOE and again request s

DOE assistance. Transnuclear plans to send this request to the several DOE offices (including Mr. Donald Ofte, the Deputy Assistant Secretary for Defense Programs) which have a role in making a decision deciding this matter.
